【摘要】 根据利益主体及其相互间关系,将区域环境纠纷分为政府间的纠纷、生产经营者与公众之间的纠纷、生产经营者之间的纠纷、政府与生产经营者和公众之间的纠纷等四类。"私力救济"、"商调机制"、诉讼解决等代表性的相关解纷途径以及环境信访、调解、仲裁、约谈等措施,与四类纠纷有复杂的对应性。然而,私力救济存在无序性;政府间"商调机制"存在弱程序性以及效力不确定性;司法解决还存在制度性不完善;多元解纷措施缺乏衔接和协调。应该以"生态环境整体性协作治理"作为逻辑出发点和基本理念,以全局视野、系统思维、体系化方法,从整体性上把握、以协作性为标准优化纠纷解决措施,形成"联防联治—非诉讼解决—司法权威裁判"的区域环境纠纷防控与解决体系,实现环境纠纷解决机制的生态化和系统化。更多还原

【Abstract】 According to the interest subjects and their relations, trans-administrative ecological and environmental disputes can be divided into four types: inter-governmental disputes, disputes between producers and the public, disputes between producers and the public, and disputes between governments and producers and the public. The current representative ways to resolve disputes can be summarized as "private relief", "negotiation &coordination mechanism", litigation settlement, and other non-litigation settlement measures,such as environmental petition, mediation, arbitration and interview. However, private relief lacks legal normativity. The inter-governmental "negotiation & coordination mechanism" has weak procedure and uncertainty of effectiveness. The system of judicial settlement is not perfect, the cost is high and is hysteretic. Pluralistic dispute settlement measures lack cohesion and coordination. " The integrity and cooperation of ecological governance" should be the logical starting point and the basic concept. With an integrity vision, systems thinking,systematic method, from an overall understanding, based on collaborative optimization measures to resolve disputes, this article aims to form a regional environmental disputes settlement system of "joint prevention and control, non-litigation solution, and judicial authority to judge", and to systematize and ecologicalize the environmental dispute settlement mechanism.更多还原
