中医药法视角下中医诊所经营中两种常见的法律风险与防范

【摘要】 《中医药法》的实施提升了中医诊所的活力,但是中医诊所经营中的法律风险也随之增加。而在中医诊所经营的诸多法律风险中,与中医诊所配制中药制剂和医疗损害责任分担相关的法律风险较为常见。因此,应当严格遵循"一人一方"原则、明确约定医疗损害责任分担规则以及完善中医师参与医疗责任保险机制以防范因配制中药制剂和分担医疗损害责任产生的法律风险。更多还原

【Abstract】 The implementation of Chinese medicine law has enhanced the vitality of Chinese Medicine clinics, however it also increases the legal risks in the operation of Chinese Medicine clinics.Among the legal risks in the operation of Chinese Medicine clinics, it is common for the legal risks related to the preparation of Chinese Medicine preparations and the shared liability for medical damages.therefore it is necessary to strictly follow the principle of "one man,one prescription", expressly appoint the rules of sharing medical damage liability, and perfect the mechanism of the traditional Chinese physician participating in medical liability insurance to prevent the legal risks of compounding Chinese medicine preparation and sharing the medical damage liability.更多还原
