【摘要】 《科技进步法》第20、21条意在推进特定领域的科学研发和商业繁荣。但是因其自身的局限性,需要介入权来威慑和鞭策承包人加快专利转化效率。遗憾的是,我国《科技进步法》中现有的介入权机制规定过于原则,在实践中无法实施。本文通过不同角度论证介入权的正当性,并借鉴美国介入权实践经验,提出我国应从行使条件、行使方式方面构建符合我国国情的介入权机制的立法建议。为了增加制度的可操作性,本文建议在介入权行使条件中构建"合理价格"、"合理期限"和"社会公益和国家利益"三套标准。同时,为防止国家干预权力的滥用,应借鉴公司股份制限制介入权的行使方式,在政府投资比例较小的科研项目中部分限制政府的介入权。更多还原

【Abstract】 The Science and Technology Law China enacted in 2007 meant to boost business prosperity and increasing the public access to the new inventions. However, Science and Technology Law have its unavoidable defect that need March-in rights’ overawing to ensure efficiency of patent transfer. Nonetheless, the "March-in rights provision" in current Chinese Science and Technology Law is not without deficient.It actually could not be practically used. This article demonstrates the justification from different angles. By drawing lessons from United States, author suggest that our legislative institution should establish "March-in rights provision" based on China’s own national conditions in the matter of implementation subject, conditions, approaches and remedy procedure. In order to improve the operability of regulations, the standard of "reasonable price""reasonable duration" and " Interests of the general public and Nation" shall be established in implementation conditions of March-in rights. Moreover, to prevent abuse of intervention power, implementation approaches of March-in rights should be partially restricted in low proportion government-invested project.更多还原
