【摘要】 大气对人类的生存和发展至关重要,人类要想健康长久的发展,必然要关心大气的自然情况。在工业化高度发达的今天,环境问题突出,其中大气污染日益严重,严重影响人类的生活质量和身体健康,大气污染防治逐渐成为全球普遍关注的热点话题。而法律则是缓解大气污染问题的重要手段。大气环境使用权交易制度的设立,就是人类防治大气污染经济制度法律化的具体体现。目前,该制度在我国的法律实践中还存在着些许瑕疵。借鉴西方国家的先进立法经验,不断完善我国大气环境使用权制度,对提高我国环境事业的整体水平意义重大。更多还原

【Abstract】 The atmosphere is essential to human survival and social development, people want to be healthy and long-term development, must be concerned about the natural atmosphere.At present, industrialization develop highly, environmental problems are becoming increasingly serious, especilly air pollution problem. It impacts on the quality of human life and health seriously, the prevention and control of atmospheric pollution has become a hot topic of global concern. And the law is an important means to alleviate air pollution problem. The establishment of trade system of the right to use environment is the embodiment of the economic system of human air pollution prevention into law. At present, the system in our country’s legal practice still exist some flaws. From western countries advanced legislative experience, and constantly improve the right to the use system of atmospheric environment in our country, it has a great significance to improve the overall level of China’s environmental.更多还原
