【摘要】 本文通过对印度征地制度进行研究,从中提出对中国征地制度改革有益的借鉴。采用了比较研究法和文献资料法,研究认为:虽然印度在土地产权制度上同中国存在根本的差别,但是由于相似的国情以及同样由于经济发展需要而正在进行着大量的征地实践,该国在征地方面仍然有不少值得我们借鉴的经验。通过比较中国征地制度,提出值得中国学习借鉴的6个方面:制定《土地征用法》;区分"公共利益"和"非公共利益";提高补偿标准;加强公众参与;建立仲裁制度;将有争议的征地补偿款投资。更多还原

【Abstract】 The purpose of this study is to extract some useful experiences from Indian land acquisition system and apply to China’s land acquisition system reform.Methods of empirical study and documentation were employed.Although Indian land property right system differs from China totally,there are also some experiences China can use in the practice of land acquisition,because this two countries share the same situation due to huge population in the world.Comparing Indian’s land acquisition system with China’s situation,seven countermeasures were put forward to insult China acquisition practice.That is,enacting "Land Acquisition Act",distinguishing "for public needs" and "for non-public needs",raising the compensation standard,improving public participation,setting up reasonable arbitration system,investing disputed land acquisition compensation.更多还原
