【摘要】 本文首先从法经济学的发展脉络中梳理出其两条迥异的研究路径并分析其成因,据此澄清学术界在法经济学范畴上存在的以偏概全的不足;其次,从新古典经济学和新制度经济学研究纲领比较的视角分析这两种研究取向,指出其分别具有的新古典主义和新制度主义属性,并将之称为新古典主义法经济学和新制度主义法经济学;最后指出当前我们应该大力加强对后者的研究,以增加对法律制度影响经济绩效理论的认识。更多还原

【Abstract】 At first,the paper hackles two different research approaches of the past of law and economics,then analyses its theoretical causes,so that we can rectify the bias in the categories of the law and economics.Secondly,it construes the two approaches at the angle of the comparisons between the neo-classical economics and neo-institutional economics,and points out their neo-classicalism and neo-institutionalism characters respectively.At last,presently we should pay more attention to the neo-institutionalism law and economics.更多还原
