【摘要】 目的:理顺药品行政执法与刑事司法的关系,强化药品执法力度,为修改药品管理法奠定理论基础。方法:运用规范研究方法、比较法学和案例分析法对中美药品行刑联动机制作深入的比较分析。结果与结论:通过研究发现我国药品执法行刑联动机制所存在问题,借鉴美国药品行刑联动机制建设经验,提出药品管理法的修改建议。更多还原

【Abstract】 Object:In order to rationalize relationship between the drug law enforcement and criminal justice,to strengthen drug law enforcement,and lay a theoretical foundation for the amendment of the Pharmaceutical Administration Law;Methods:have a comparative analysis for the linkage mechanism of administrative organs and criminal justice agencies in China and the USA through specification studies, comparative law,case studies;Results and Conclusions:there are still some deficiency in the linkage mechanism of administrative organs and criminal justice agencies of China.We propose some suggestions for the amendment of the Pharmaceutical Administration Law upon successful experiences of the FDA.更多还原
