【摘要】 农村大学生是我国城乡二元经济体制下的产生的一个特殊身份群体,兼有城市和农村的双重身份。农村大学生入学前属于农业户口,依法享有一份土地承包经营权,入学后大部分大学生转为城市非农业户口,面对农村大学生由"农"转为"非农"身份上的变化,政府部门、集体经济组织以及社会上的其他人员对于其原先拥有的土地承包经营权持有不同的观点和看法,本文阐述了农村大学生对原承包经营权的合法拥有性权利,强调农村大学生对土地承包经营权的用益物权不因户口的转变而丧失,构建了农村大学生土地承包经营权经营和管理的方式和途径,并提出了规范农村大学生土地承包经营权的对策和建议。更多还原

【Abstract】 The university student from rural area occurring under the urban-rural dual economy system in China is a special group, these students have two identities: non-agriculture and agriculture residence. They held the agricultural residence registration before enrollment in university; they possess the land contracting management right according to the law. After matriculation most of these students register as the non-agriculture residents, meanwhile, they will be faced with the identity change from "agriculture" to "non-agriculture". The government, collective economic organization and other people in the society hold the different views on the land contracting management right possessed by these students. This paper argues that these students possess the legal rights for their former land contracting management right, and it emphasizes that these students willn’t lose the usufructuary right of this right on account of the registered residence change, besides, it raises the proper means and approach for managing the land contracting management right. Finally, it provides some suggestions and strategies to regulate the land contracting management right possessed by the students from rural area.更多还原
