【摘要】 在当前石漠化仍呈扩展趋势且防治形势十分严峻,而国内石漠化防治法律制度供给又存在严重不足的情况下,为推进石漠化地区生态文明建设进而促进全面可持续发展,加强中国石漠化防治法制建设势在必行。在加强中国石漠化防治法制建设的过程中,必须妥善选择能够调动一切石漠化防治力量的石漠化防治法律制度模式。所谓石漠化防治法律制度模式是指为防治石漠化,维护生态安全,促进经济和社会可持续发展所制石漠化防治法律制度之内外部机制的标准形式或标准样式。根据法律关系主体在石漠化防治法律关系中所处法律地位以及法律关系主体间权利与义务性质与内容,石漠化防治法律制度可以分为以下命令控制型、引导激励型两种基本模式。在中国石漠化防治立法中,应与时俱进地扬弃命令控制型石漠化防治法律制度,选择并构建引导激励型石漠化防治法律制度。更多还原

【Abstract】 Rock desertification continues to show the expanding tendency and the serious prevention and control situation, but the domestic legal systems of the prevention and control of rock desertification are in short supply. In order to promote ecological civilization construction and comprehensive sustainable development in rock desertification districts, we should strengthen the legal construction of the prevention and control of rock desertification in China. In the course of strengthening the legal construction of the prevention and control of rock desertification in China, we should choose the model which can call all possible forces of the prevention and control of rock desertification of the legal systems of the prevention and control of rock desertification. The model of the legal systems of the prevention and control of rock desertification is the standard form or style of the internal and external mechanism of the legal systems of the prevention and control of rock desertification which are made or enacted to prevent and control rock desertification, safeguard the safety of ecosystem and promote the sustainable development of economy and society. According to the legal statuses of the subjects of legal relations in the legal relations of the prevention and control of rock desertification and the natures and contents of the rights and duties of the subjects of legal relations, the legal systems of the prevention and control of rock desertification are divided into two basic models of the commanding and the incentive. In the domestic legislation for the prevention and control of rock desertification in China, we should develop the useful and discard the useless of the commanding legal systems of the prevention and control of rock desertification, choose and establish the incentive legal systems of the prevention and control of rock desertification.更多还原
