【摘要】 在资源环境问题已经成为我国国民经济和社会的进一步发展的瓶颈问题的情况下,我国的环境法制建设如何为解决这个瓶颈问题做出贡献?本文基于对我国资源环境管理现状的分析,运用经济学和法学相关"政府失灵"问题的基本原理,借鉴国外的有益经验,指出我国当前的环境法制建设应当以克服"政府失灵"现象为工作重点,提出并论证通过修改《环保法》或者制定新法来解决"政府落实科学发展观"、"克服环境管制的‘政府失灵’"和"建立和加强对行政部门影响环境的行政行为的社会监督机制"三个重大问题。更多还原

【Abstract】 How can the further development of environmental law in China contribute to overcoming the challenge of the bottleneck to the further development of national economic and social development? Based upon relevant theories of economics and jurisprudence as well as the current situation of environmental management in China, the author points out that the key to the question is to focus on the problem of "governmental failure" in environmental regulation. The author further advocates that there are three major issues to be solved by amendment existing environmental law or by making a new law. The three issues are: firstly, how to make the government as a whole and at all levels to practice the concept of scientific development? Secondly, how to overcome the governmental failure in natural resource and environmental regulation? And thirdly, how to establish a effective social supervision to the administrative decisions and actions having significant environmental impacts?更多还原
