试论我国环境法基本原则

【摘要】 1989年颁布施行的《环境保护法》在我国环境保护实践中发挥了积极作用。但是,随着时代的变迁和国内外社会、经济、政治和环境保护形势的发展变化,《环境保护法》已难以适应时代和环保工作的需求,在实践中存在许多问题和障碍,急需进行修改和完善。为了适应新时代的发展,我国的环境法急需进行修改。而其中,环境法的基本原则是修改的重中之重。环境法的基本原则贯穿于整个环境法体系,对贯彻和实施环境法有普遍的指导作用,关于环境法的基本原则应包括哪些内容,法学界观点颇多,至今尚未形成统一的认识。这也反映了环境法作为一门新兴的独立法律部门仍处于不断完善阶段。本文,正是针对环境法中的基本原则问题,提出自己的几点看法和建议,提出了符合环境法发展趋势的基本原则。更多还原

【Abstract】 1989 "promulgated by the Environmental Protection Act," Environmental Protection in China practice has played a positive role. However, with changing times and in the domestic and international social, economic, political and environmental changes in the situation. "Environmental Protection Law" has been difficult to adapt to the times and the needs of environmental protection work, in practice there are many problems and obstacles the urgent need to amend and improve. To adapt to the new era of development, China’s environmental law in need of revision. Which, environmental law is the basic principle of the most important changes. Environmental law through the basic principles of environmental law in the entire system of implementation and enforcement of environmental law is generally the guiding role on the basic environmental law principles of what should be included, law experts view lot, and we have not yet formed a unified understanding. It also reflects the environmental law as an emerging independent legal departments are still at the developing stage. This article is for the environmental law’s basic principles, made their points of view and suggestions the environmental law with the development trend of the basic principles.更多还原
