【摘要】 修订我国现行《环境保护法》为环境基本法已基本达成共识。如何在环境基本法中对公众参与做出规定,应是环境基本法的重要内容。本文在分析国外环境法中公众参与规定的基础上,认为我国环境基本法应在总则中明确公众参与原则和公众的参与权,在分则中设专章对公众参与予以规定,并在“法律责任”章中明确违反公众参与规定的法律责任。更多还原

【Abstract】 Revising the existing Environmental Protection Law of our country to be environmental basic law has basically reached a consensus. How to stipulate the public participation in the environmental basic law should be the important content of the environmental basic law. On the base of analyzing the provisions of public participation in the foreign countries’ environmental law, the paper think that the environmental basic law should make certain the principle of public participation and the public’s participation right in the general principles, set a special chapter to stipulate the public participation in the subprovision, and make certain the legal responsibility of breaking the provisions of public participation in the chapter of “legal responsibility”.更多还原
