【摘要】 矿权包括探矿权和采矿权,是我国矿产资源的基本权利。长期以来,对于矿权的行使问题一直存在着争论。在我国,矿产资源的所有权属于国家勿庸置疑,但国家可以授权矿权人进行勘探、开发并取得收益。在这样一个模式下,建立一个合理有序的矿权交易市场就显得尤为重要。我国目前的矿权市场存在很多的问题,完善我国的矿权市场法制体系,将有利于国家以及矿权人更好的维护自己的利益,也利于与国际惯例接轨。更多还原

【Abstract】 The mineral rights include the right of exploration and the right of exploitation. They are both basic rights of mineral resource. And there are also exist some dispute about the performance of the rights. The ownership of mineral resource is belong to the country, and the country could authorize people to explore and exploit the mine, and get the profit. In this mode, it is important to set up a orderly mineral rights deal market. There are many problems in our market, so improve the legal system of our market will benefit the country and the people, also can get closer to the international custom.更多还原
