【摘要】 资源性土地应成为民法物权的一种独立客体,我国对资源性土地的物权制度规定不成体系,大多散见于与土地有关的资源法中,据此,笔者认为应该建立并完善资源性土地的物权法律制度。本文从资源性土地的概念界定入手,明确把资源性土地的物权类型规制为资源性土地所有权与资源性土地使用权,然后从资源性土地所有权人、使用权人和其他任何人对资源性土地所负义务的角度探讨了资源性土地的物权效力,籍此以更好地维护土地资源和生态、生活与生存环境。更多还原

【Abstract】 Land with resources should become a kind of independent object of real right of the civil law. The stipulations in the system of real right of land with resources haven’t been a perfect system in China, and most stipulations are embodied in the resources laws which has relation to land. So, the author thinks China should construct and perfect the system of real right of land with resources. This thesis begins with the conception of land with resources and definitely prescribes the type of real right of land with resources as ownership of land with resources and use right of land with resources. Then, this thesis inquires into the validity of real right of land with resources from the duties on land with resources that the ownership holder of land with resources, the holder of use right of land with resources and the others should bear. By way of the system of real right of land with resources, we may maintain the resources of land and the ecological, life and existence environment more effectively.更多还原
