【摘要】 目的:探究精神病人受审能力的影响因素。方法:对在四川大学华西基础医学与法医学院法医精神病学教研室进行法医精神病学鉴定的170名被鉴定人进行受审能力评定,评定研究对象的受审能力、精神症状,收集其人口学资料、犯罪学资料,采用统计描述、t检验、x~2检验、秩和检验和logistic回归分析等方法研究精神病人受审能力的影响因素。结果:BPRS的思维障碍因子、激活性因子、PANSS的P分对受审能力具有显著影响;无受审能力组病理性和不明作案动机比例较高、既往精神病阳性率较高、既往暴力史阳性率较高,且与有受审能力组相比差别具有统计学意义;无受审能力组言语智商低于有受审能力组,差别具有统计学意义;无受审能力组精神分裂症比例较高,差别具有统计学意义。结论:BPRS的思维障碍因子、激活性因子、PANSS的P分、言语智商、精神疾病诊断、既往精神病史,既往暴力史、作案动机,职业、文化程度等对精神病人受审能力具有一定影响。更多还原

【Abstract】 to explore the affecting factors of mental disorder offender’s competency to stand trial. Method: assess 170 pre-trial criminal suspect or defendants’ competency to stand trial in the department of Forensic Psychiatry Forensic Medicine College Sichuan University, scale their psychological symptoms with BPRS and PANSS, collect their demographic and criminal data, then explore the affecting factors of the mental disorder offender’s competency to stand trial by means of analyzing these data using statistics description, t-test, chi-square test, rank-sum test and logistic regression analysis. Result: Thinking disorder factor and active factor of BPRS and P value of PANSS affect the competency to stand trial significantly; in the incompetent to stand trial (IST) group, peasant’s ratio, pathological and unclear motivation’s ratio, schizophrenia diagnose ration low education ratio, positive mental disorder history and violent history ratio are all higher than those in the competent to stand trial (CST) group; the VIQ scores of the IST group is lower than that of the CST group, and all the deference have statistics significance. Conclusion: Thinking disorder factor and active factor of BPRS, P value of PANSS, VIQ, mental disorder diagnose, mental disorder and violent behavior history, criminal motivation, occupation and education of the interviewee may affect his/her competency to stand trial obviously.更多还原
