【摘要】 互联网保险作为互联网技术与保险行业深度融合的金融形态,虽然具有高效性、虚拟性、信息易获取性等显著特征,但并未改变保险的本质和基本运作方式。然而,这种创新实践与现有法律规范体系之间产生了明显的结构性矛盾,尤其在保险人提示说明义务领域,传统保险人说明义务在互联网背景下面临着三重困境:说明义务范围不清晰、方式存争议、标准不明确。为解决互联网保险人说明义务存在的问题,应系统研究我国立法与司法实践现状,借鉴日本与德国的成熟经验,引入“重要事项判断标准”,以“概括加列举”方式界定说明范围,并将程序性事项纳入说明范围。此外,还可以引入“咨询义务”,重构“主动咨询+询问说明”的分级说明机制,规范投保流程并完善犹豫期制度,实现从形式告知到实质理解的转变,推动互联网保险说明义务的制度完善与实践优化。更多还原

【Abstract】 Internet insurance,as a financial form of deep integration of Internet technology and insurance industry,has not changed the essence and basic operation mode of insurance,although it has significant features such as high efficiency,virtualization and easy access to information.However,this innovative practice and the existing legal normative system have created obvious structural contradictions,especially in the field of insurer’s obligation to indicate,the traditional insurer’s obligation to indicate in the context of the Internet is faced with a triple dilemma:the scope of the obligation to indicate is unclear,the way is controversial,and the standard is not clear.In order to solve the problems of Internet insurer’s duty of explanation,we should systematically study the current situation of China’s legislation and judicial practice,learn from the mature experience of Japan and Germany,introduce the"judgment standard of important matters",define the scope of explanation by"generalization and enumeration",and include procedural matters in the scope of explanation.Procedural matters should be included in the scope of the explanations.In addition,it is also possible to introduce the"duty to consult",reconstruct the hierarchical explanation mechanism of"active consultation+inquiry and explanation",standardize the insurance process and improve the hesitation period system,so as to realize the transformation from formal notification to substantive understanding,and to promote the system improvement and practice optimization of the duty to explain in Internet insurance.Perfection and practice optimization of the duty of explanation in internet insurance.更多还原
