【摘要】 在大数据时代,数据成为了现代社会基础性的社会资源。大数据拥有改造社会的强大力量,带来了生产力的变革,成为了继暴力、财富和知识后的一种新型获取权力的途径。伴随着平台企业由“私”入“公”介入公共治理,权力关系发生转移,大型平台企业凭借大量数据资源的占有和先进技术的掌控,已对社会各方面形成了较强影响力和控制力,正逐渐成为数据权力中心,传统的“公权力-私权利”二元结构向“公权力-私权力-私权利”三元结构转化。基于此,研究平台企业公共权力的治理一方面有利于发挥平台企业对社会的有效治理,帮助政府实现治理的科学化,精细化,协同化,另一方面有利于对平台企业公共权力的规制,更好地发挥“有形的手”对平台企业进行监督和管理,实现公私协力。本文以平台企业公共权力为研究对象,主要探讨平台企业公共权力权力关系和权力特性、平台企业公共权力运行后带来的治理现状、成因分析、影响力及如何实现平台企业公共权力的有效治理。以数权理论、公共权力理论、治理理论为理论框架,通过对大数据权力、平台企业权力和数据治理等关键概念和问题进行文献综述,并结合“蚂蚁金服暂缓上市”案例分析确定了企业公共权力生成逻辑、运行逻辑、现实影响、对策创新的研究结构,研究主要结果包括:一、在平台企业公共权力关系上,其呈现不对称的相互依赖关系,兼具公共性和特殊性双重属性,具体表现为隐蔽的支配性、强制性和扩张性;二、以“蚂蚁金服暂缓上市”案例分析大数据视角下企业公共权力发生过程,发现平台企业公共权力运行存在的问题为企业公权责任认定问题、权力运行规范问题、权力运行透明性问题;三、应辩证看待平台企业公共权力运行所带来的影响,企业公共权力的运行提高了政府公共决策的效率,改善了公共服务供给。但是,平台企业对于数据黑箱和数据伪造的操作,影响着治理的效果;四、基于企业公权力运行存在的问题及企业公共权力运行的影响,为了实现平台企业公共权力有效治理,应从制度创新、公私协力、技术创新和监督机制四方面展开。更多还原

【Abstract】 In the era of big data,data has become the basic social resource of modern society.Big data has a powerful power to transform society,bring about changes in productivity,and become a new way to obtain power after violence,wealth and knowledge.With the platform enterprises’ involvement in public governance from "private" to "public",the power relationship has shifted.With the possession of a large number of data resources and the control of advanced technology,large platform enterprises have formed a strong influence and control over all aspects of society,and are gradually becoming the center of data power.The traditional binary structure of "public power-private rights" has been transformed into a ternary structure of "public power-private power-private rights".Based on this,on the one hand,the research on the public power of platform enterprises is conducive to give full play to the effective governance of platform enterprises to the society,and help the government to realize the scientific,refined and collaborative governance;on the other hand,it is conducive to the regulation of public power of platform enterprises,better give play to the "visible hand" to supervise and manage platform enterprises,and realize public-private cooperation.Taking the public power of platform enterprises as the research object,this paper mainly discusses the power relationship and power characteristics of public power of platform enterprises,the governance status,cause analysis,influence and how to realize the effective governance of public power of platform enterprises.Based on the theoretical framework of number power theory,power theory and governance theory,through the literature review of key concepts and problems such as big data power,platform enterprise power and data governance,and combined with the case analysis of "ant financial service suspension of listing",the research structure focuses on the generation logic,operation logic,practical influence and countermeasure innovation of enterprise public power,and the main results of the research include: First,in terms of public power relations of platform enterprises,it presents asymmetric interdependence,with dual attributes of publicity and particularity,specifically manifested as hidden dominance,coercion and expansion;Second,taking the case of "ant financial service suspension of listing" to analyze the occurrence process of corporate public power from the perspective of big data,it is found that the problems existing in the operation of public power of platform enterprises are the identification of corporate public power responsibility,the standardization of power operation and the transparency of power operation;Third,we should dialectically look at the impact of the operation of platform enterprise public power.The operation of enterprise public power improves the efficiency of government public decision-making and the supply of public services.However,the operation of platform enterprises on data black box and data forgery affects the effect of governance;Fourth,based on the problems existing in the operation of enterprise public power and the impact of the operation of enterprise public power,in order to realize the effective governance of platform enterprise public power,it should be carried out from four aspects: system innovation,public-private cooperation,technological innovation and supervision mechanism.更多还原
