【摘要】 人民民主一直被视为现代社会的基本价值之一,其形式与内容已经在世界各国的宪法中得到充分体现。全过程人民民主是在宪法实施的各个环节和阶段,通过全民参与、广泛协商和有效监督等方式,确保宪法在各个领域和层面得到全面实施的一种民主制度。全过程人民民主构建了人民当家作主的制度框架,自提出全过程人民民主理念以来,引发了学者们广泛的关注和充分的研究。对全过程人民民主的宪法保障进行研究,具有重大而深刻的意义,能够丰富对全过程人民民主的研究视域,增强宪法的权威性。宪法是国家的根本法,对于宪法,我们唯有捍卫其尊严,怀揣敬畏之心,并给予尊重,才能够让全过程人民民主更加稳步地推进,人民当家作主才能真正得以实现。对于全过程人民民主宪法保障的研究,首先,通过分析比较法视野下全过程人民民主的独特价值,认识到全过程人民民主是对我国民主制度的创新性发展,是对西方民主的批判性超越。其次,以全过程人民民主的内涵为出发点,论述全过程人民民主的宪法表达,其中,宪法为全过程人民民主构建了规范体系、提供了制度载体,宪法基本原则为全过程人民民主提供了理论支撑。再次,通过全过程人民民主的具体实施,对全过程人民民主的宪法实现状况加以论述。最后,指出全过程人民民主在发展过程中的不足,主要是全过程人民民主的制度机制有待健全,公民权利保障有待加强,过分强调全过程容易使民主失焦,合宪性审查制度有待强化等,进而有针对性地提出完善全过程人民民主的路径。宪法在规范全过程人民民主的发展的同时,全过程人民民主也能推动宪法的实施和完善,全过程人民民主的实现也将为社会的进步与发展提供强大动力。更多还原

【Abstract】 People’s democracy has always been regarded as one of the fundamental values of modern society,and its form and content have been fully reflected in the constitutions of various countries around the world.The whole process of people’s democracy is a democratic system that ensures the comprehensive implementation of the Constitution in various fields and levels through the participation of the whole people,extensive consultation,and effective supervision at all stages and stages of the implementation of the Constitution.The whole process of people’s democracy has built a institutional framework for people to be the masters of their own affairs.Since the concept of whole process people’s democracy was proposed,it has attracted widespread attention and sufficient research from scholars.Studying the constitutional guarantee of the entire process of people’s democracy has significant and profound significance,which can enrich the research perspective of the entire process of people’s democracy and enhance the authority of the constitution.The Constitution is the fundamental law of a country.Only by defending its dignity,holding a sense of reverence,and respecting it,can we make the entire process of people’s democracy progress more steadily,and the people become masters of their own country truly realized.For the study of constitutional guarantees for the entire process of people’s democracy,firstly,by analyzing the unique value of the entire process of people’s democracy from the perspective of comparative law,it is recognized that the entire process of people’s democracy is an innovative development of China’s democratic system and a critical transcendence of Western democracy.Secondly,starting from the connotation of full process people’s democracy,this paper discusses the constitutional expression of full process people’s democracy.Among them,the constitution constructs a normative system and provides an institutional carrier for full process people’s democracy,and the basic principles of the constitution provide theoretical support for full process people’s democracy.Once again,through the specific implementation of the entire process of people’s democracy,the constitutional implementation status of the entire process of people’s democracy will be discussed.Finally,it is pointed out that the shortcomings of the entire process of people’s democracy in the development process are mainly due to the need to improve the institutional mechanisms of the entire process of people’s democracy,strengthen the protection of civil rights,overemphasize the entire process,which can easily cause democracy to lose focus,and strengthen the constitutional review system.Therefore,targeted paths are proposed to improve the entire process of people’s democracy.The Constitution not only regulates the development of people’s democracy throughout the entire process,but also promotes the implementation and improvement of the Constitution.The realization of people’s democracy throughout the entire process will provide strong impetus for social progress and development.更多还原
