【摘要】 一直以来,社会治理体系和治理能力的现代化是我国社会发展的重要努力方向,也是社会主义现代化的制度基础。基层治理作为治理结构和治理体系的重要构成,是国家发展路径的基础。人民调解是基层社会治理的重要途经,是实现“资源下沉、重心下移”重要方式。面对伴随社会发展而日益增加的经济纠纷、家庭纠纷、生命安全纠纷等基层问题和矛盾,Y市C镇响应政府号召,积极成立人民调解委员会,在解析基层矛盾成因、寻求长效机制发挥了不可取代的基层治理的作用。在风险社会理论指导下,本文分析了C镇人民调解委员会在基层社会治理的实践过程,探究现有的调解方式、调解流程对C镇常见的经济纠纷、生命健康纠纷、损害赔偿纠纷以及家庭事务赔偿纠纷的作用,发现人民调解面临诸多问题。在调解主体中,专业人员不足、调解委员会权威性低、调解效率低影响调解成效,服务对象层面中,村民求助意识淡薄、法律观念落后以及契约精神缺乏的问题进一步影响调解活动的开展,而在调解内容层面,矛盾与服务的不匹配,方法与需求的不适应以及流程与解决问题的迫切性的矛盾将影响后续调解的进行。除此之外,环境层面中,人民调解的政策环境、社会认可环境以及监管环境差持续影响人民调解的作用的长效发挥。在此基础上,本文试图提出解决方法和完善路径,以提升调解人员的专业性,树立调解委员会的权威性,提高调解效率和效果。并增加调解员的群众意识,提高基层法制化水平,对调解的效力予以保护和支持。与此同时,将不断完善调解内容,构建“大调解”社会矛盾处理机制。并加强政社合作,加大社会宣传力度,成立第三方监管,发挥其在基层治理的广泛性功能。图2幅,表1个,参考文献89篇更多还原

【Abstract】 The modernization of the social governance system and governance capacity has always been an important direction for my country’s social development and the institutional basis for socialist modernization.As an important component of the governance structure and governance system,grassroots governance is the foundation of a country’s development path.People’s mediation is an important way of grass-roots social governance,and an important way to achieve"resource sinking and lowering of the center of gravity".Faced with the increasing economic disputes,family disputes,life safety disputes and other grassroots problems and contradictions accompanying social development,Town C of Y City responded to the government’s call and actively established a people’s mediation committee,which has played an important role in analyzing the causes of grassroots conflicts and seeking a long-term mechanism.irreplaceable role of grassroots governance.Under the guidance of the risk society theory,this paper analyzes the practice process of the people’s mediation committee in town C in grass-roots social governance,and explores how the existing mediation methods and mediation processes affect the common economic disputes,life and health disputes,damage compensation disputes and family affairs in town C The role of compensation disputes found that people’s mediation faces many problems.Among the mediation subjects,the lack of professionals,the low authority of the mediation committee,and the low mediation efficiency affect the effectiveness of mediation.At the service target level,the villagers’weak awareness of asking for help,backward legal concepts,and lack of contract spirit further affect the development of mediation activities.At the mediation content level,the mismatch between contradictions and services,the incompatibility of methods and needs,and the contradiction between processes and the urgency of solving problems will affect the subsequent mediation.In addition,at the environmental level,the policy environment,social recognition environment and poor regulatory environment of people’s mediation continue to affect the long-term play of the role of people’s mediation.On this basis,this paper attempts to propose solutions and improvement paths to enhance the professionalism of mediators,establish the authority of the mediation committee,and improve the efficiency and effect of mediation.And increase the public awareness of mediators,improve the level of legalization at the grass-roots level,and protect and support the effectiveness of mediation.At the same time,we will continue to improve the content of mediation and build a "big mediation"mechanism for dealing with social conflicts.And strengthen the cooperation between government and society,increase social publicity efforts,and establish third-party supervision.Play its extensive function in grassroots governance.更多还原
