县域社区矫正对象教育帮扶的路径研究

【摘要】 2019年《社区矫正法》的出台为社区矫正提供法律指引的同时,也对社区矫正工作的实践转型提出了新的要求。在此背景下如何拓宽社区矫正教育帮扶工作的发展路径,采取何种方法改善该领域的实践机制,成为新时代我国特色社会主义背景下矫正社会工作发展创新的新议题。本研究选取A省J县18个基层司法所作为调研地点,以生态系统理论为视角,采用半结构访谈法与文本分析法针对县域社区矫正工作教育帮扶的现实情况开展调研,重点分析了因社区矫正对象身份转变带来的生态系统重组问题;梳理了县域社会资源的特殊性、社会组织与政府和社会三方合作策略、社区矫正对象教育帮扶的需求与多方协调问题。对县域中司法系统与当地政府“条块关系”的合作、市区与乡镇社区矫正教育帮扶可利用资源的差异、“自下而上”与“自上而下”教育帮扶工作的途径等方面进行了对策分析。将新公共管理理论嵌入社会工作行政要件,提出将教育帮扶理念由管理转为服务、政策设计与基层力量双向结合、社会工作方法发挥实务作用等建议,在全面推进服务型政府的时代背景下更好地把握我国社区矫正工作的发展节点,反映社区矫正教育帮扶领域的时代特点。更多还原

【Abstract】 The introduction of the Community Correction Law in 2019 provides legal guidance for community correction,and also puts forward new requirements for the practice transformation of community correction work.Under the background of socialism with Chinese characteristics in the new era,how to broaden the development path of community correction education assistance work and what method to take to improve the practice mechanism in this field have become the new issues of the development and innovation of correction social work.In this study,18 grassroots judicial offices in J county of A province were selected as the research sites.From the perspective of ecosystem theory,semi-structured interview method and text analysis method were adopted to investigate the practical situation of education and assistance in county community correction work,focusing on the analysis of ecosystem restructuring caused by the identity change of community correction objects.The particularity of county social resources,the tripartite cooperation strategies of social organizations,the government and society,the needs of education and assistance for community correction objects and the problems of multi-party coordination were sorted out.Countermeasures are analyzed in terms of the cooperation between the judicial system and the local government in the county,the difference between the available resources of urban and township community correctional education and assistance,and the ways of "bottom-up" and "top-down" education and assistance work.This paper uses new public management theory to embed the administrative elements of social work,proposes suggestions such as transforming educational help concept from management to service,combining policy design and grassroots forces,playing a practical role of social work methods,and so on.Under the background of promoting the service government,it can better grasp the development node of community correction work in our country,reflecting the characteristics of The Times in the field of community correction education.更多还原
