【摘要】 本文立足于基层法院法官助理制度的改革现状,分析法官助理制度在基层法院采用的模式、实践的效果以及应当解决的问题,提出若干改良法官助理制度的建议。本文主要包括五个部分。第一部分是法官助理制度的概述,主要介绍了法官助理制度的概念、特点以及我国法官助理制度的制度价值。第二部分讲述了法官助理制度的产生与演变,分析其产生动因,梳理法官助理制度从产生到发展的源流脉络。第三部分从基本数据入手,探究基层法院法官助理制度改革概况及其成效,通过分析研究深圳市龙华区人民法院以及临沂市兰山区人民法院两个基层法院的调研数据,对法官助理制度在基层法院的运行现状进行深入探讨。第四部分指出了我国基层法院法官助理制度在运行过程中存在的来源混乱、配置不科学、职责定位不明、职业前景不明、管理机制不健全、信息化、智能化冲击法官助理工作的问题,并分析了问题的成因。第五部分针对第四部分指出的问题进一步提出优化路径建构,从合理配置法官助理、厘清法官助理的职责范围、完善法官助理选任机制、明确法官助理职业前景、健全法官助理管理制度、利用信息化、智能化技术辅助法官助理工作六个方面提出了基层法院法官助理制度具体的优化路径,以期进一步改良我国基层法院的法官助理制度,更好的帮助法官提高审判质效。更多还原

【Abstract】 Based on the current situation of the judicial assistant system reform in the basic courts,this paper analyzes the mode adopted by the judicial assistant system in the basic courts,the effect of its operation and the problems that need to be solved and puts forward some Suggestions for improving the judicial assistant system.This paper mainly includes five parts.The first part is the overview of the judicial assistant system,mainly introduces the concept and characteristics of the judicial assistant system,the emergence and development of China’s judicial assistant system and the necessity of its implementation.The second part describes the emergence and evolution of the judicial assistant system,analyzes its causes,and sorts out the origin and development of the judicial assistant system.The third part starts from the basic data to explore the general situation and effectiveness of the reform of the judicial assistant system in the grass-roots courts.By analyzing the research data of the Longhua District People’s Court of Shenzhen and the Lanshan District People’s Court of Linyi City,the operation status of the judicial assistant system in the grass-roots courts is deeply discussed.The fourth part puts out the problems existing in the operation process of the judicial assistant system in China’s grass-roots courts,such as confusion of sources,unscientific allocation,unclear responsibility positioning,unclear career prospects,imperfect management mechanism,informatization and intelligence impact on the work of judicial assistant and analyzes the causes of the problems.The fifth part further proposes the optimization path construction according to the problems pointed out in the fourth part.The fifth part,aiming at the problems pointed out in the fourth part,puts forward the optimization path constructions,and puts forward the concrete reform and implementation plans of the judicial assistant system in the basic courts from six aspects,such as configuring judge assistants rationally,clarifying the responsibility scope of judge assistants,improving the selection mechanism of judge assistants,clarifying the career prospect of judge assistants,improving the management mechanism of judge assistants and using information and intelligent technology to assist the work of judge assistant,so as to further improve the judicial assistant system in the basic courts in China and better help judges to improve the trial quality and efficiency.更多还原
