【摘要】 区块链与互联网都是网络空间的产物,都是依托于大量个人信息的积累。但不同于互联网的是区块链填补了互联网个人信息被非法收集的风险,以自身的技术特点保证了信息的安全。但是,正如一项新兴技术并不是完美的,区块链亦是如此。实际上,区块链只能最大程度保证信息运行的真实,却不能保证信息本身的真实,同时区块链不可删除的特征使得个人信息永久的存储在区块链中,这对个人信息造成的风险不亚于互联网。在各国不断发展区块链的背景下,原有的个人信息保护显然无法与区块链相适应。如何平衡区块链与个人信息保护的冲突,是当前立法亟待思考的问题。因此,为解决冲突有必要重新审视各国原有的个人信息保护立法,在欧盟确立的“被遗忘权”概念基础上结合区块链的特殊性,从而构建具有弹性、温和的被遗忘权,用于保护区块链背景下的个人信息安全。而我国同样面临区块链发展过程中产生的个人信息保护问题,与域外国家不同的是我国未有专门的个人信息保护法,已有的有关保护规定分散在相关法律法规当中,而且仅停留在已经发生侵害的个人信息安全的补救上,未涉及到有关个人信息的被遗忘权,显然这对于个人信息保护是不足的,因此,在区块链下背景下更具有研究该权利的理论和现实需要。互联网时代的被遗忘权试图回应数字记忆带来的遗忘难题,而区块链背景下的被遗忘权试图解决“删除”的难为。二者的目的都是信息主体想要打破数字记忆,恢复人类的记忆周期回归生活的安宁。如果说“删除”或者删除权是互联网之下个人信息保护的最后环节,那么在区块链背景下被遗忘权才是个人信息保护的最后环节。本文分为五个章节,第一章导论部分包括区块链背景下被遗忘权研究背景、意义、现状方法;第二章阐述区块链及其特殊性对个人信息的挑战;第三章对区块链背景下我国个人信息被遗忘权保护的必要性和可行性进行分析;第四章从比较分析的角度阐述域外个人信息被遗忘权状况;第五章在总结前文的基础上,提出区块链背景下我国个人信息被遗忘权的保护路径的建议,以期能够助于个人信息保护与区块链协调。更多还原

【Abstract】 Blockchain is regarded as the fifth technological innovation after the Internet,blockchain and the Internet are the products of cyberspace,both rely on the accumulation of a large amount of personal information.But what is different from the Internet is that blockchain fills the risk that personal information on the Internet is illegally collected,ensuring the security of information with its own technical characteristics,but just as an emerging technology is not perfect,so is blockchain.In fact,blockchain can only guarantee the authenticity of information operation to the maximum extent,but can not guarantee the authenticity of the information itself,while blockchain nondeleteable characteristics make personal information permanently stored in the blockchain,which poses no less risk to personal information than the Internet.In the context of the continuous development of blockchain in various countries,it is clear that the original protection of personal information can not be adapted to blockchain.How to balance the conflict between blockchain and personal information protection is an urgent problem to be considered in the current legislation.Therefore,in order to solve the conflict,it is necessary to re-examine the original personal information protection legislation of various countries,and combine the speciality of blockchain on the basis of the concept of "right to be forgotten" established by the European Union,so as to construct the security of personal information in the context of flexible and gentle right to be forgotten in the context of protected area blockchain.China is also facing the problem of personal information protection in the process of blockchain development,unlike extraterriter countries,there is no special personal information protection law in China,the existing protection provisions are scattered in the relevant laws and regulations,and only stay in the security of personal information has been violated on the remedy,not related to the right to forget personal information,obviously this is insufficient for personal information protection,so in the context of blockchain has the theoretical and practical need to study this right.The right to forget in the Internet age tries to respond to the problem of forgetting brought about by digital memory,while the right to forget in the context of blockchain tries to solve the difficulty of "deletion",but both aim at the information subject to break digital memory and restore the peace of life of the human memory cycle.If the right to delete or delete is the last link of personal information protection under the Internet,then the right to be forgotten in the context of blockchain is the last link of personal information protection.This paper is composed of five parts.The first chapter includes the background,significance,current situation and methods of the right to be forgotten in the context of blockchain The third chapter analyzes the necessity and feasibility of the protection of personal information right to be forgotten under the background of Blockchain;the Fourth Chapter elaborates the situation of personal information right to be forgotten from the angle of Comparative Analysis;This paper puts forward some suggestions on the protection path of personal information right to be forgotten under the background of Blockchain,in order to help the protection of personal information and the coordination of blockchain.更多还原
