【副题名】以长春市净月区为例

【摘要】 2017年10月18日,党的十九大报告提出了中国发展新的历史方位——中国特色社会主义进入了新时代。深化机构和行政体制改革是新时代坚持和发展中国特色社会主义民主政治的重要任务。在《中共中央关于深化党和国家机构改革的决定》中指出,要完善市场监督管理和执法体制,改革和理顺市场监督管理体制,整合监管职能,加强监管协同,形成市场监督整体合力。然而近些年经过多次分分合合,市场监管仍然存在一定问题,例如监管主体单一、职能界限模糊不清、人员结构分配不合理、法律保障体系不完善等。笔者对长春市净月开发区市场监督管理体制改革前后对比、现状分析以及长春净月开发区市场监督管理体制改革过程资料收集,发现存在基层监管部门衔接不畅、人员结构不合理、编制严重不足整个组织架构成倒三角型、执法保障体系不完善、法律体系滞后等问题,产生这些问题的原因可以归纳为上层设计欠缺综合考量、政府监管主体力量薄弱未能联合其他主体、市场主体素质有待提高肩负起主体责任。本文结合笔者所在的长春市净月区市场监管部门,对亲身经历机构改革合并过程及改革后取得的成果和出现的问题、不足进行分析,总结原因,进而针对原因提出合理化建议,加强顶层设计、增强市场监管主体力量、提升市场主体责任意识,建立市场监管共治格局。同时,从长春市市场监管改革事例中总结监管理论,为全国建立统一的完善的市场监管体系提供有力参考。更多还原

【Abstract】 Deepening the reform of institutions and administrative system is an important task for upholding and developing socialist democratic politics with Chinese characteristics in the new era.The report of the 19 th National Congress of the Communist Party of China puts forward clear requirements for deepening the reform of institutions and administrative systems,points out that it is necessary to consider all kinds of institutional settings,scientifically allocate the powers and responsibilities of Party and government departments and internal institutions,and specify the direction and path of reform in the next five years.In the "decision of the CPC Central Committee on deepening the reform of Party and state institutions",it is pointed out that the market supervision and management and law enforcement system should be improved,the market supervision and management system should be reformed and straightened out,the supervision functions should be integrated,the supervision coordination should be strengthened,and the joint force of market supervision and management should be formed.However,in recent years,there are still some problems in market supervision,such as single regulatory body,unclear functional boundaries,unreasonable distribution of personnel structure,imperfect legal protection system and so on.The author of Changchun market supervision and management system reform before and after the comparison,analysis of the status quo,as well as Changchun Jingyue Development Zone market supervision and management system reform process data collection,found that the grass-roots supervision department convergence is not smooth,the personnel structure is not reasonable,the establishment is seriously insufficient,the whole organizational structure constitutes an inverted triangle,the law enforcement guarantee system is not perfect,the legal system lags behind and so on The reasons for the problems can be summarized as the lack of comprehensive considerationof the upper design,the weak power of the government regulatory body,the failure to unite with other subjects,and the quality of the market subject needs to be improved to shoulder the main responsibility.In this paper,the author analyzes the reasons for the market reform,and proposes to strengthen the market supervision mechanism 。 At the same time,this paper summarizes the supervision theory from the case of Changchun market supervision reform,which provides a strong reference for the establishment of a unified and perfect market supervision system.更多还原
