【摘要】 社区矫正适用前社会调查评估工作作为社区矫正工作开展前的一个重要环节,不但能为检察院、法院以及其他有关机构提供参考意见,提高社区矫正适用的准确性,也能增强社区矫正工作人员对被调查对象的了解,有利于后续监督管理工作的开展。随着社区矫正工作量的进一步增加,社区矫正适用前社会调查评估制度的作用必将进一步凸显。然而,由于我国社区矫正尚未实现专门的立法,缺少对该项制度的完备规定,导致该项制度在现实中的作用还远远没有发挥出来。为了促进该项制度的完善,笔者采用实地调研的方式对该项制度的具体实践情况进行了深入地考察。笔者以Y市H区的该项工作的开展情况为调研对象,通过考察,笔者总结出了该区在这项工作实施中存在的主要问题,如调查评估的适用条件不明确、对调查评估工作缺乏正确的认识、调查评估队伍专业性不足、调查评估程序不完善、调查评估过程无有效监督等。以上这些问题在很大程度上都制约了该地区调查评估工作的进一步发展,急需解决。针对当前存在的这些问题,笔者根据走访访谈、数据调查以及个案调查了解到的情况并结合当下前沿的资料积极的探索解决问题的办法,对调查评估的适用条件、认识情况、队伍组成、程序、方式、内容以及监督方面都提出了相应的完善措施,以期更好的发挥该项制度在社区矫正实践中的作用。更多还原

【Abstract】 The social survey and evaluation before the application of community correction as an important link before the development of community corrections can not only provide reference for procuratorates,courts and other relevant institutions,but also enhance the understanding of the respondents by the community correction staff,which is conductive to the development of follow-up supervision and management.With the further increase of the workload of community corrections,the role of the community survey and evaluation system before the community corrections will be further highlighted.However,due to the lack of special legislation in community of corrections in China and the lack of complete regulations on the system,the role of this system is still far from being realized in reality.In order to promote the improvement of the system,the author conducted a thorough investigation of the specific practice of the system by means of field research.The author took the development of this work in the H district of Y city as the research object.Through investigation,the author summarized the main problems in the implementation of this work in the area,such as the unclear application conditions of the investigation and evaluation.Further problems were lack of correct understanding,lack of professionalism in the investigation and evaluation team,imperfect investigation and evaluation procedures and lack of effective supervision in the investigation and evaluation process.To a large extent,these problems have restri cted the further development of the survey and evaluation work in the region and urgently need to be resolved.In view of the current problems,the author actively explores the solutions to the problems based on the interviews,data surveys and case invest igations.The author also actively explores the methods for solving the problems,corresponding conditions,understanding,team composition,procedures,methods,content and supervision of the investigation and evaluation and has put forward corresponding measures to better the role of the system in community correction practice.更多还原
