【摘要】 传统的商业方法通过各种现代化的电子设备加以实施,形成了网络商业方法,进而成为专利保护的客体。然而,商业方法专利的实质审查标准在各国之间,存在很大的差异。研究我国的商业方法专利的实质审查标准,提高相关专利的审查质量,对引导企业创新,有着非常重要的意义。商业方法专利是利用技术手段创造商业信息、并收集、整合和处理的方法。商业方法专利的本质应是商业方法为主体,技术手段配合商业方法的实施的手段。基于这样的理解,本文认为,商业方法专利的客体审查应该纳入非技术特征,并且审查标准应为“硬件标准”。在此基础上,商业方法专利的新颖性和创造性审查都应当既审查技术层面又审查非技术层面。一方面,在审查新颖性时,由于非技术特征的加入,为了更准确地评价非技术特征,应将检索对象从“现有技术”扩充为“现有文献”,并在适用“整体相同”原则时考虑商业层面是否整体相同,只有技术层面和商业方法层面均整体相同时,商业方法专利才无法通过新颖性审查,二者之一整体相同则无法否定新颖性。另一方面,在审查创造性时,除了审查技术层面的创新,也要审查非技术层面的创新。非技术特征的创造也就是商业方法的创新,体现为对商业信息的创造、收集、整合、处理的创新方法。传统的“三步法”无法很好的审查非技术层面的创新,因此需要引入整体审查法。商业方法专利权利要求中的技术手段、商业方法、以及二者的结合,均应对创造性有所贡献,其贡献由大到小的顺序应为:技术、技术与商业方法的结合、商业方法。更多还原

【Abstract】 Traditional business methods are implemented through a variety of modern electronic devices,forming a network business method that becomes the object of patent protection.However,the substantive examination criteria for business method patents vary widely from country to country.It is of great significance to study the substantive examination standards of commercial method patents in China and improve the quality of examination of related patents.Business method patents are methods that use technology to create,collect,integrate,and process business information.The essence of business method patents should be the means by which business methods are the mainstay and technical means are used in conjunction with the implementation of commercial methods.Based on this understanding,this paper argues that the object review of business method patents should incorporate non-technical features,and that the review criteria should be “hardware standards”.On this basis,the novelty and creative review of business method patents should review both the technical and non-technical aspects.On the one hand,in the review of novelty,in order to more accurately evaluate non-technical features due to the addition of non-technical features,the search target should be expanded from “prior art” to “existing literature”,and the “whole overall” should be applied.In principle,it is considered whether the business level is the same overall.Only when the technical level and the business method level are the same,the business method patent cannot pass the novelty review.If the two are the same,the novelty cannot be denied.On the other hand,when reviewing creativity,in addition to reviewing technical innovations,it is also necessary to review innovations at the non-technical level.The creation of non-technical features is the innovation of business methods,embodied in innovative methods for the creation,collection,integration and processing of business information.The traditional “three-step approach” does not allow for a good review of non-technical innovations,so an overall review approach needs to be introduced.The technical means,commercial methods,and combinations of the two in the commercial method patent claims should contribute to creativity.The order of contribution from large to small should be: the combination of technology,technology and business methods,and business methods.更多还原
