【摘要】 终身监禁刑广泛存在于世界各国的刑罚体系中,作为自由刑的一种,其在刑罚体系中的严厉性仅次于死刑,在废除死刑的国家里,终身监禁刑更是作为最严厉的刑罚出现的。在不同的国家,终身监禁刑在名称与适用标准上等内容上也各不相同。在死刑的限制与废除的呼声日益高涨的今天,终身监禁刑在刑罚体系中的作用也愈加受到重视。研究终身监禁刑对于深入理解其在刑罚结构中的价值,进一步发挥它作为主要刑罚的功能等方面都具有重要意义。在我国于2015年出台的《刑法修正案(九)》中,对最严重的贪污受贿犯罪规定了终身监禁制度,那么其与我国的终身监禁刑(即无期徒刑)之间的联系和区别在哪里,这一新出现的终身监禁制度应如何定位,又有怎样的刑罚价值,在司法实践中应如何适用等问题需要进一步明确。终身监禁刑分类有绝对与相对的终身监禁刑、不得减刑假释与可减刑假释的终身监禁刑、强制劳动与无劳动的终身监禁刑,并且终身监禁刑的功能为特殊预防功能与一般预防功能。绝对的终身监禁刑与不得减刑的终身监禁刑并不为世界大多数国家采用。我国《刑九》规定的终身监禁与域外终身监禁刑明显不同,因为其并不是独立的刑种且只严格适用于贪污受贿犯罪。我国终身监禁是依附于死刑缓期执行制度与无期制度而存在的特殊刑罚措施,能够改善我国死刑偏重、生刑偏轻的刑罚结构缺陷,兼顾废除死刑和限制死刑的双重功能。我国终身监禁只适用于严重贪污受贿犯罪、时间效力以有利被告为原则、在死缓期间有重大立功行为可不再适用终身监禁,无期徒刑期间即使有重大立功行为也不得减刑、假释。更多还原

【Abstract】 Life imprisonment is widespread in the penalty system in the world,as a free punishment,its severity in the penalty system only after the death penalty,in the country which have repealed the death penalty,life imprisonment is the most severe penalty.In different countries,life imprisonment is also different in the name and application of standards etc.Nowadays,the role of life imprisonment in the penalty system is getting more and more attention.The study of life imprisonment is of great significance to deeply understand its value in the penalty structure and to further develop its function as the main penalty.Our country in 2015 promulgated the "Criminal Law Amendment(9)",the most serious corruption and bribery provides for life imprisonment system,then its life imprisonment and our links between the difference and where this emerging How should the system of life imprisonment be located,what kind of system value,how to apply in judicial practice and other issues need to be further clarified.Life imprisonment is the classification of absolute and relative life imprisonment,commutation and parole and commutation and parole shall be life imprisonment,forced labor and non labor life imprisonment,life imprisonment and punishment function for the special prevention and general prevention function function.The absolute life imprisonment sentence and the life imprisonment sentence that cannot be commuted are not adopted by most countries in the world.China’s life imprisonment and the penalty of life imprisonment is obviously different,because it is not an independent punishment and is strictly applicable to the crime of corruption and bribery.China’s life imprisonment penalty measures depend on the death penalty reprieve system and no system exists,can improve our death penalty structure,emphasis on student punishment too light,the dual function of both the abolition of the death penalty and the restriction of death penalty.Life imprisonment in China applies only to serious crime of corruption and bribery,the validity of time to the defendant for the principle,there is great merit in the act is no longer applicable during the period of reprieve to life imprisonment,life imprisonment during even if there are major meritorious service or commutation and parole.更多还原
