【摘要】 随着城镇化进程的加快,城市土地供不应求,城郊农村土地不断被征用。在这个过程中,城郊农村宅基地也在征用中流转。与此同时,大量城郊农民进城购房,农村房屋和宅基地大量空置。在农村宅基地缺乏合理的流转模式和退出机制的情况下,农村宅基地私下流转和闲置现象共生。本文在对国内外有关农村宅基地文献综述的基础上,通过对湖北省鄂州市城郊农村大湾村和华光村进行实地调研,分析了我国宅基地使用权流转的基本现状、问题及其成因,对现行的流转模式进行了评述,发现现行模式对农民权益保护方面存在不足,进而提出了以政府为主导的农村宅基地使用权流转新模式。笔者认为政府主导农村宅基地使用权流转更具优势,政府通过加强政策引导,搭建宅基地流转平台,为宅基地流转提供制度保障等,可有效、公平、公正的推进农村宅基地使用的流转。更多还原

【Abstract】 With the acceleration of urbanization,the supply of urban land is in short supply,and suburban rural land is continuously being expropriated.In this process,suburban rural homesteads are also requisitioned for circulation.At the same time,a large number of suburban peasants are buying houses in cities,and rural houses and homesteads are largely vacant.In the absence of a reasonable transfer mode and exit mechanism in rural housing sites,the phenomenon of private homestead circulation and idleness is symbiotic.Based on the literature review of homesteads in rural areas both at home and abroad,this paper conducts on-the-spot investigations into rural Dawan Village and Huaguang Village in the suburbs of Ezhou City,Hubei Province,and analyzes the basic status quo,problems and causes of the use right transfer of homesteads in China.The current circulation model was reviewed and it was discovered that the current model has deficiencies in the protection of farmers’ rights and interests,and then proposed a government-led new model for the transfer of rural residential land use rights.The author believes that the government dominates the transfer of the use right of rural residential land.The government can effectively,fairly,and impartially promote the circulation of rural housing land by strengthening policy guidance,setting up homestead circulation platforms,and providing institutional guarantees for homestead circulation.更多还原
