【摘要】 近年来,特别是改革开放以来,我国的医疗卫生事业,无论是在制度建设、医疗水平、经费保证等方面都取得了长足的进步。与此同时,随着人民生活水平的提高,人民对身体健康、心理健康以及人文关怀等方面的期待也在不断提高,对优质医疗资源的需求更是迎来了“井喷期”。这也就导致了医疗纠纷的发生成了一种短期内无法消失的现实。特别是目前我国中西部的基层医疗水平还有待于进一步提高,人民群众的医疗卫生知识相对匮乏,导致医疗纠纷易发多发,更有甚者出现暴力袭击医务人员的情况。而人民调解作为一种调动民间力量化解矛盾纠纷的手段,在基层的矛盾化解工作中发挥着越来越重要的作用。将人民调解引入医疗纠纷的解决成为了基层化解医疗纠纷的一种有益尝试。2012年6月K区司法局、卫生局就在辖区内创建了医疗纠纷人民调解协会,对由医疗纠纷的产生纠纷的化解取得了显著的成效,但在实践中也暴露出了一系列问题,诸如经费保障不足、队伍建设和管理水平低、配套制度不完善等问题,为此,应当多渠道解决保障问题、创新管理方式、完善配套制度,建立以人民调解为枢纽的多元医疗纠纷解决机制,既保障医疗纠纷能够高效、公正的解决,又维护正常的医疗秩序。更多还原

【Abstract】 In recent years,especially since the reform and opening up,China’s medical and health undertakings have made great progress in terms of system construction,medical care,and funding guarantees.At the same time,with the improvement of people’s living standards,people’s expectations for their own physical health,mental health,and humanistic care are also constantly improving,and the demand for quality medical resources is ushering in the “blowout period”.This has led to the emergence of medical disputes as a reality that cannot be eliminated in the short term.In particular,at present,the level of basic medical care in the central and western regions of China still needs to be further improved.The people’s lack of medical and health knowledge has led to frequent and prolific medical disputes,and even more violent attacks on medical personnel.People’s mediation,as a means to mobilize non-governmental forces to resolve contradictions and disputes,has played an increasingly important role in the elimination of conflicts at the grassroots level.The introduction of people’s mediation into the resolution of medical disputes has become a useful attempt to resolve medical disputes at the grassroots level.In June 2012,the K District Bureau of Justice and the Health Bureau established the Medical Dispute People’s Mediation Association within its jurisdiction,which has achieved remarkable results in resolving disputes arising from medical disputes.However,a series of problems have also been exposed in practice.Problems such as inadequate funding guarantees,low level of team building and management,and inadequate supporting systems,should be achieved through multiple channels to solve security problems,innovate management methods,improve supporting systems,and establish a multi-discipline medical dispute resolution mechanism centered on people’s mediation.It ensures that medical disputes can be resolved in an efficient and fair manner and maintains a normal medical order.更多还原
