【副题名】以我国外资准入制度为视角

【摘要】 法治是目前为止人类社会中对于国家治理来说最好的方式。虽然迄今为止关于法治的确切含义还没达成统一的认识,但目前已经达成共识的是法律至上、公平正义等概念是法治的基本内涵。法治这个概念由来已久,传统上所说的法治大多指国内法治。然而,随着国际社会一体化进程的不断发展,法治的形态不仅仅只停留在国内,国际法治也开始产生。国际法治与国内法治既有相同之处,也有不同之处。两者的相同之处在于都体现了良法和善治的核心要素,而两者的区别主要体现于孕育氛围、衍生环境、发展路径、表现形式、价值蕴含、理论基础等方面。虽然两者在诸多方面存在区别,但不可否认的是两者之间存在着强烈的互动需求。然而,由于各个国家法治发展的水平不一,国内法治比较发达的国家其国内法治能更多地影响到国际法治,推动国际法治进步,而国内法治比较落后的国家的过多的是受到国际法治进步的影响,从而推动本国国内法治的发展。在外资准入相关的法律制度方面,也有着国际法治和国内法治的互动,如“规则导向”理念和国民待遇原则等较为先进的法治理念为法治发展较为落后国家提供了良好的立法方向,同时也为这些国家改革外资准入制度提供了动力,而与“规则导向”理念和国民待遇原则相关的相关的负面清单制度、准入前国民待遇原则则提供了良好的立法模板。本文立足于我国与外资准入相关的法律制度的基本情况,通过分析“规则导向”理念、国民待遇原则等国际上较为先进的法治发展成果对我国外资准入制度法治化发展的促进作用来印证国际法治的进步对于国内法治进步的促进作用,并就我国如何立足自身的实际情况更好地利用国际法治的促进作用提出自己的见解。更多还原

【Abstract】 To the human society,rule of law is the best governance form to the country and society.Although there is no consensus to the exact meaning of rule of law has been reached until now,however what has been reached consensus is the basic meaning of rule of law,which contains supremacy of law as well as fairness and justice.The concept of rule of law has a long history,traditionally it means rule of law within a country.Nevertheless,with the development of international integration,the form of rule of law is not constrained within the bound of the country anymore,it also occurs on international level.There are differences and consistencies between international rule of law and domestic rule of law.Rule of law on international level and domestic level share some common points is terms of nurture atmosphere,derived environment,development path,forms,value implication and theoretical basis.In spite of the differences between international rule of law ans domestic rule of law,however the strong interactive needs between them is not negligible.However,due to the differences between the development level of the rule of law between countries,countries with higher development level of domestic rule of law have more positive impact to the international rule of law than countries with lower development level of domestic rule of law.The development of international rule of law is basically promoted by countries with higher development level of domestic rule of law and produce impact to countries with lower development level of domestic rule of law.In the term of the mechanism of admission of foreign capital investment,interaction between international rule of law and domestic rule of law also exists.Some advanced ideologies of constitutionality,such as rule-oriented ideology and the principle of national treatment,provide good direction of legislation to countries with lower development level of domestic rule of law,meanwhile motive the revolution of mechanism of admission of foreign capital investment of those countries.Negative list and pre-establishment national treatment provide positive Legislative template.This article based on the basic situation of mechanism of admission of foreign capital investment of China,through the analyses of the promotion of some achievements of international rule of law,such as rule-oriented ideology and the principle of national treatment,to the domestic international rule of law to prove the promotion of international rule of law to the domestic rule of law.Besides,the author provide own opinions to the issue that how China take advantage of the positive effect of international rule of law stand on our own position.更多还原
