【摘要】 环境损害政府责任是指政府及其公务人员在代表国家实施环境管理活动过程中,因违法或未履行环境建设和保护的相应职责和义务而应当承担的否定性后果。环境损害政府责任既包含了政府保护环境的第一性义务即政府应尽的环境保护职责和义务,又包含了因没有适当履行义务所应承担的惩罚性后果,既是一种事前责任,又是一种事后责任。在当今时代,随着经济的快速发展,环境损害问题尤为突出,政府作为管理的主体,追究其实施环境管理活动过程中所导致的环境损害责任,对于环境保护具有重要的意义。我国环境损害政府责任追究的现状是:制定并出台了关于环境损害政府责任追究的行政规章及规范性文件;明确了环境损害政府责任的处罚形式;但是,还存在着以下几个方面的问题:司法机关追究环境损害政府责任力度不足;环境损害政府责任的追究状况得不到有效监督;环境损害政府责任质询不到位。我国环境损害政府责任追究存在问题的原因包括三个方面:一是环境损害政府责任追究机制不完善;二是环境损害政府责任追究问责主体“缺位”;三是政府行为的生态绩效评估制度不完善。解决政府环境损害责任追究问题的策略包括三个方面:一是完善环境损害政府责任追究的机制;二是明确环境损害政府责任问责主体并发挥问责主体的作用;三是完善政府行为的生态绩效评估制度。更多还原

【Abstract】 The government responsibility for environmental damage refers to the negative consequences that the government and its public servants should undertake in the process of carrying out environmental management activities on behalf of the state.The government responsibility for environmental damage includes both the first obligation of the government to protect the environment,that is,the duties and obligations of the environment that the government should fulfill.It also includes the punitive consequences that do not fulfill the obligations properly,which is both an ex ante liability and an ex post liability.In today’s era,with the rapid development of economy,the problem of environmental damage is particularly prominent.As the main body of management,the government is responsible for environmental damage caused by environmental management activities,which is of great significance for environmental protection.China’s environmental damage situation of government accountability is formulated and issued a document on the administrative regulations and normative government responsibility for the environmental damage;the environmental damage penalty in the form of government responsibility;however,there are still some problems as follows:the judicial organ for investigation of environmental damage responsibility of the government is insufficient;government responsibility for environmental damage if the situation is not the effective supervision of environmental damage;government responsibility question is not in place.China’s environmental damage the government accountability problems include three aspects:one is the environmental damage the government accountability mechanism is not perfect;two is the environmental damage the government accountability accountability subject "Absence";three is the government behavior ecological performance evaluation system is not perfect.To solve the environmental damage problems of administrative accountability strategy includes three aspects:one is to improve the mechanism of environmental damage to government accountability;the two is a clear environmental damage responsibility of the government accountability and accountability play the main role;the three is the evaluation system of ecological performance evaluation to improve the government behavior.更多还原
