以审判为中心若干基本问题研究

【摘要】 随着十八届四中全会的召开,我国的“以审判为中心”诉讼制度改革越来越受到国家和人民的重视。尤其是立法机关和司法机关积极响应,纷纷公布了自己的关于“以审判为中心”诉讼制度改革的文件和配套制度。我国立法机关和司法机关的关注,也使得这一改革极大的激发了法律工作者、法律研究者以及公民的参与热情,更好的促进改革措施的实施与推进。本文正是在这样的背景下进行研究和创作,通过广泛阅读收集材料信息,翻阅法律典籍,最终得出一些浅薄的个人见解和想法。论文主要通过分析我国侦查机关,检察机关,审判机关这三大机关对这一改革的具体应对措施,德美日三国相类似改革措施的经验教训,来更好的分析和理解当前我国所进行的一系列围绕“以审判为中心”的诉讼制度改革的举措。通过对我国当前推进此项改革现状以及所面临的问题的分析,诸如“侦查中心主义”盛行,证据裁判原则贯彻不彻底的问题等。结合国内外法律大家的见解和著述,分法院、公检、当事人三个主体角度进行了建议,这也是本文相对其他文章比较新颖之处。更多还原

【Abstract】 With the convening of the Fourth Plenary Session of the 18 th CPC Central Committee,China’s "center of trial" litigation system reform has been paid more and more attention by the state and the people.Especially the legislature and the judiciary to respond positively,have announced their own on the " center of trial " litigation system reform documents and supporting system.The concern of our legislature and the judiciary has also made this reform a great boost to the enthusiasm of legal workers,legal researchers and citizens,and better promote the implementation and promotion of reform measures.This article is in this context of research and creation,through extensive reading of the collection of material information,read the legal books,and ultimately come to some shallow personal views and ideas.Through the analysis of the specific measures of the three major organs of the Chinese authorities,the procuratorial organs and the judicial organs,the author analyzes and understands the experiences and experiences of the three countries in the United States and Japan.A series of initiatives around the "center of trial " litigation system reform.Through the analysis of China’s current situation and the problems faced by the reform,such as "investigation center" prevail,the principle of evidence referee does not thoroughly implement the problem.Combined with the views and writings of domestic and foreign law,sub-court,public inspection,the three main point of the proposal,which is relative to the previous articles on the subject of other novels.更多还原
