检察机关案件监督管理运行机制研究

【摘要】 公正执法是检察工作永恒的主题。实践证明,检察机关原有的内部案件监督管理模式已经不适应社会发展及检察工作所面临的新形势。2011年11月最高人民检察院成立案件监督管理办公室。负责规范案件办理,加强内部监督,提高执法办案的质量和效率、增强检察公信力。但基层案件监督管理实践发现,检察机关案件监督管理工作没有经验可循,摸着石子过河,尚未形成统一规范的运行模式。本文以淮安市两级院案件监督管理部门工作实践为基础,开展调查分析。发现案件监督管理机构存在设立不独立、职能定位不统一、工作机制不完善、职责履行受限、人员配备不适应案件监督管理工作开展的需要等诸多问题。基层检察院面对“案多人少”的现实情况,应该及时转变案件管理工作理念,保证案件管理机构的独立性并赋予其权威性、进一步明确案件监督管理机构的监督职能、剔除大量事务性工作,完善案件监督管理工作机制、优化案件监督管理人员配置,为案件监督管理机构充分履行职责创造良好的环境,保障案件监督管理机构监督职能的充分显现。更多还原

【Abstract】 Impartial law enforcement is the eternal theme of the procuratorial work.Practice has proved that the original supervision and management mode of internal cases has not adapted to the new situation of social development and procuratorial work.November 2011 Supreme People’s Procuratorate set up the case supervision and management office.Responsible for handling the case,strengthen internal supervision,improve the quality and efficiency of law enforcement investigators,and enhance the credibility of the prosecution.However,grassroots cases of supervision and management practice found that the prosecution case supervision and management work has no experience to follow,feeling the stones across the river,has not yet formed a unified and standardized operation mode.In this paper,Huaian municipal hospital case supervision and management departments to carry out investigation and analysis based on the practice.Found that the supervision institution is not independent,the establishment of case functions are not unified,the work mechanism is not perfect,to fulfill the responsibilities of personnel is limited,can not meet the needs of the supervision and management of the case to carry out the problems.In the face of the reality of grass-roots procuratorate case much less",should change the case management,case management mechanism to ensure independence and give its authority,to further clarify the regulatory mechanism of the case supervision function,eliminate many affairs,improve the supervision and management of the case work mechanism,optimization of case supervision and management personnel.Create a good environment for the supervision and management mechanism of cases fully perform their duties,to fully show the safeguards function of supervision and management mechanism of the case.更多还原
