【摘要】 随着会展业的迅速发展,人们逐渐认识到展会经济所带来的巨大的经济效益,不仅包括其本身带来的经济效益,还包括它对其他产业的拉动效益,展会成为各地经济发展的助推器,因此各地对展会的重视程度一直有增无减。然而,在会展业快速发展的同时,展会知识产权侵权现象频发,屡禁不止,不仅展品本身所包含的专利权、注册商标权等遭到他人的侵犯,与展品相关的其他客体如展台、展具等参展设计往往也会被其他参展商擅自模仿,展会知识产权保护问题成为了会展业发展过程中的重要瓶颈,也成为人们持续关注并亟需解决的问题。目前,我国对知识产权保护适用的保护模式是行政保护和司法保护并行的双轨制,展会的知识产权保护当然也适用这种模式安排。本文以行政保护为入手点,结合展会知识产权保护的特殊性,分析了展会知识产权行政保护的权利主体及客体,并以广州展会专利执法维权的调查分析为例,通过实证研究对现行展会知识产权行政保护的现状及问题进行分析及评价,然后对我国主要展会省市北京、上海、广州三地近年来在展会知识产权行政保护实践中的具体做法予以分析,同时研究阐述境外发达国家及地区在展会知识产权行政保护取得的经验,并展示德国、瑞士、美国和香港等国家和地区的展会知识产权保护的特色做法,以及对我国相关制度的借鉴意义,从而提出完善我国展会知识产权行政保护的措施建议,以期使我国展会行政执法更加高效、便捷。更多还原

【Abstract】 With the rapid development of the exhibition industry,people have gradually realized the great economic benefit brought by the exhibition economy,including the economic benefit,as well as its driving of other industries.Exhibition turns to be the booster of economic development in various regions.Consequently,increasing attention has been paid to exhibitions.However,during the rapid development of the exhibition industry,the infringement of exhibition intellectual property occurs frequently despite repeated prohibitions.Not only are patent rights and registered trademarks of exhibits infringed,but also other objects related to the exhibits,such as the exhibition stand and appliance are imitated by other exhibitors.The intellectual property protection of the exhibition becomes important bottlenecks in the development process,as well as the urgent problem that should be resolved.In this paper,the subject of right and object of the administrative protection of exhibition intellectual property is analyzed by starting from the administrative protection and combining the particularity of exhibition intellectual property protection.Meanwhile,with the investigation and analysis of exhibition patent law enforcement and rights protection in Guangzhou as an example,the current status and problems of the administrative protection of the exhibition intellectual property are analyzed and evaluated with empirical studies.Afterwards,specific practices in the administrative protection of exhibition intellectual property in primary exhibition provinces and cities like Beijing,Shanghai,Guangzhou are analyzed.In the meantime,experience of overseas developed countries and regions in protecting the exhibition intellectual property is illustrated,and special practices in the exhibition intellection property protection in countries and regions like Germany,Switzerland,America and Hong Kong,etc.are displayed.Besides,the referential significance for related systems in China is pointed out.Eventually,suggestions of improving the administrative protection of exhibition intellectual property are put forward,for realizing more efficient and convenient law enforcement for exhibitions in China.更多还原
