【摘要】 科技成果转化是科学技术转变为现实生产力的重要途径。成果转化过程中,科技成果权属是根本性问题,事关科技成果的产出和转化。不厘清科技成果权属,科技成果转化机制体制的障碍就不能根本性解决。目前,国家法律的层面已明确了政府资助形成的成果知识产权由项目承担单位取得,且将科技成果“所有权、使用权、处置权、收益权”等下放给高校、科研机构,但是最核心的科技成果所有权仍然存在一定制度问题,即现行制度下我国的高校、科研机构国有事业单位身份导致科技成果现实所有人的虚拟化以及科技成果权属中科研人员始终不能取得成果所有权等问题和局限,导致科技成果转化过程中的市场机制未能充分发挥作用,致使单位和科研人员转化的动力不足。针对目前财政资助项目科技成果转化存在的权属不清、单位和个人成果转化动力不足等问题,在我国深化科技体制改革精神指导下,在学习借鉴发达国家改革经验的基础上,根据广东省科技成果转化工作的实际需求,笔者将结合在省内科研机构长期从事科技政策法规研究的工作实践,拟对广东省财政资助科技成果权属问题进行研究,提出相关的立法建议。第一章,绪论。介绍本文研究背景、研究问题、研究内容及方法以及本文研究意义。第二章,财政资助科技成果权属理论概述。首先分析财政资助科技成果涉及的有关概念,重点分析财政资资助科技成果不同于一般科技成果、职务科技成果等特有的属性。其次分析财政资助科技成果的功能定位。最后,分析财政资助科技成果归于不同的主体的利弊分析。第三章,分析广东财政资助项目科技成果转化的现状。首先是广东财政资助科技投入的现状分析,其次是广东财政资助科技投入产出的现状分析,最后是广东财政资助科技成果转化的评价分析。第四章,分析广东财政资助项目科技成果权属制度存在的主要问题。首先分析广东省财政资助科技成果权属制度存在的主要问题。其次分析我国财政资助科技成果权属政策法律演进和现行规定,我国科技成果权属政策法律规定是一个渐进式的权力下放和放开的过程。最后,分析广东省现行关于财政资助科技成果权属的政策法规规定。第五章,比较分析国内外财政资助项目科技成果权属制度。首先是对美国、日本等主要发达国家关于国家财政资助科技成果或知识产权权属相关政策和制度进行比较分析。其次是对目前我国部分省市地区财政资助科技成果权属制度进行比较分析。最后,总结提出对广东财政资助项目科技成果权属制度改革的启示和借鉴。第六章,在借鉴国外立法经验以及分析广东省实践情况的基础上,对广东省财政资助科技成果权属制度改革进行合理性必要性分析、基本原则分析、具体建议分析等,广东财政资助项目科技成果权属制度完善提供借鉴参考。更多还原

【Abstract】 The transformation of scientific and technological achievements is an important way to transform science and technology into practical productive forces.During the transformation of achievements,Scientific and Technological Achievements Ownership is a fundamental problem,concerned output and transformation of scientific and technological achievements.If you do not clarify the ownership of scientific and technological achievements,the obstacles to the system of the transformation of scientific and technological achievements can not be solved at all.The level of national law has made it clear that the intellectual property rights of the achievements made by the government have been obtained by the project undertaking unit.But the core of scientific and technological achievements,there are still some problems in the system of ownership.That is,under the current system of China’s universities,research institutions,the identity of the status of scientific and technological achievements of the reality of all human virtualization and scientific research personnel can not get the results of ownership and other issues,leading to the failure of the market mechanism to fully play a role and unit and scientific research personnel lack of conversion power.In view of these questions,under the guidance of the spirit of deepening the reform of science and technology system in our country,learning from the experiences of developed countries for reference,according to the actual demand of the transformation of scientific and technological achievements in Guangdong Province,the author will combine the work practice of science and technology policy and regulation research in the Department of internal medicine,will research of scientific and Technological Achievements Ownership Reform of Guangdong Public Finances.The first chapter is nntroduction.The main content is research background,research questions,research contents,research method and research meaning.The second chapter is about the relevant concepts involved in the results of financial aid projects,mainly introduces the basic concepts of financial capital,the ownership of scientific and technological achievements,focus on the analysis of the financial capital of scientific and technological achievements are different from the general scientific and technological achievements,such as the special characteristics of the title of the property.And analysed function of financial scientific and technological achievements.The third is different owners of the financial support for scientific and technological achievements.The third chapter is about the present situation of the transformation of financial scientific and technological achievements.The first is the investment of science and Technology Finance in Guangdong.The second is the output of scientific and technological financial in Guangdong.The third is the comparative analysis of input and output in Guangdong.The four chapter is about the main problems existing in the system of financial support for scientific and technological achievements in Guangdong.The first is the history of the evolution of the policies and laws of the management of science and technology in China.The second is existing policies and regulations of Guangdong Province on the ownership of financial aid to scientific and technological achievements.The third is the main problems existing in the system of financial support for scientific and technological achievements in Guangdong.The five chapter is about domestic and foreign financial support system of scientific and technological achievements.The first is the analysis of the United States,Japan,Europe and other major developed countries and regions on the national financial capital projects of scientific and technological achievements or intellectual property rights related policies.The second is the analysis of other provinces and cities in China about financial support system of scientific and technological achievements.The third is the enlightenment to Guangdong.The six chapter is about how to perfect scientific and technological achievements ownership reform of Guangdong public finances,including real demand analysis,dilemma analysis,reform principle analysis,concrete analysis and so on,to provide reference for the improvement of the system of scientific and technological achievements ownership reform of Guangdong public finances.更多还原
