【摘要】 随着我国改革开放走出去的步伐逐渐加快,越来越多的中国公民通过劳务输出走出国门,到世界各地谋职工作,为家乡带回更多的资金以及境外的技术,为社会带来了良好的经济效益。21世纪以来,中国工人海外劳务风险案例频发,有的涉及人数众多、影响广泛,中国对外劳务输出人员人身安全风险呈现多元化状态。对外劳务风险频发,严重影响在外劳务人员人身安全,严重影响外派劳务企业和中介机构企业经营效益,甚至影响国家之间的外交关系,影响国家利益。我们需要对对外劳务输出人员人身安全风险进行系统性分析,以帮助政府和企业以及个人提高防范与应付风险能力。本文将对外劳务输出人员人身安全风险划分成来自环境的风险与来自劳务输出方式的风险,进行系统性的研究,进行风险识别和原因分析,并结合遭遇索马里海盗的劳务人员获救案例进行风险研究,最后从避免风险、减弱风险、转移风险、接受风险四方面考虑,提出应对对外劳务输出人员人身安全风险的相关对策建议。本文采取了文献研究法、分类归纳法、数据分析方法、案例研究法对中国对外劳务输出人员人身安全风险相关资料和数据进行了梳理和分析。本文主要分为五个部分。第一部分是我国对外劳务输出的发展历程和发展现状。第二部分是我国对外劳务输出人员面对的人身安全风险分析,包括来自环境的风险和来自劳务输出方式的风险。第三部分是我国对外劳务输出人员人身安全风险原因分析。第四部分是我国船员遭遇索马里海盗案例。最后一部分是提出了应对我国对外劳务输出人员人身安全风险的相关避免风险对策、减弱风险对策、转移风险对策和接受风险对策,如利用政府资源、利用合同条款、利用信用保险等。科学的对策帮助中国对外劳务合作企业和劳务输出中介以及劳务个人更好的应对人身安全风险。更多还原

【Abstract】 With the pace of Chinese reform and opening up going up gradually,more citizens of China go to the world all over the work through the manner of labor export,bringing more funds and foreign technology to the home,and benefiting the society economic.Since twenty-first Century,the frequent occurrence of Chinese workers overseas labor risk cases involve a large number of people.The risk on personnel safety of Chinese laborers who work abroad show a state of diversity.The frequent foreign labor risks serious impact the foreign labor personnel safety,and affect the labor service enterprise and intermediary business,even affect the diplomatic relations between the countries,affecting the interests of our country.We need to analyze the risk of personal safety for foreign labor to help the government and enterprises and individuals improving their ability of preventing and dealing with risks.The risk of foreign labor come from the environment and the labor output mode.The systematic study on the risk combined with the case of Somali pirates rescued the risk of labor personnel.In this paper,literature research method,classification and induction method,data analysis method,case study method are used to analyze and sort out the relevant data and data about the personal safety risk of China’s foreign labor export personnel..This paper is divided into five parts.The first part is the development process and current situation of Chinese foreign labor export.The second part is the analysis of the personal security risks,including the risks from the environment and the risk of the export of labor services.The third part is the analysis of the reasons for the personal safety risk.The fourth part is the case of Somali pirates.In the last part,the author puts forward some countermeasures to avoid the risk,such as avoiding the risk,reducing the risk,transferring the risk and accepting the risk.Such as the use of government resources,the use of the terms of the contract,the use of credit insurance.Scientific countermeasures to help China foreign labor cooperation enterprises and labor export intermediary and services personal security risk.更多还原
