【副题名】以保护处分制度为视角

【摘要】 随着人类社会的不断发展,未成年人犯罪问题已成为了各个国家和地区都需要重视的严重问题。近年来,我国未成年人的犯罪率也不断上升,给我国的社会治安带来了严重的不良影响。由于受我国一贯的刑罚重刑主义观念的影响,我国刑法的惩罚力度一直较大,对于未成年人的惩处也没有采取区别于成年人的惩罚方式。在实践中注重刑罚的惩罚方式对于少年犯罪的矫治也没有收到良好的效果。伴随着国际少年刑法的发展,对于未成年犯的处置由刑罚化向非刑罚化转变已成为各国达成的共识,域外大多国家和地区制定了针对未成年犯罪的专门法律,同时通过域外的具体实践也可看到非刑罚的处置方式更有利于预防和矫治未成年人犯罪。反观我国,当前我国在未成年犯非刑罚处置措施的适用上陷于困境,主要表现在面对实践案件处理尴尬和学界的理论争议不断。究其根源是因为我国的未成年人非刑罚处置措施仍不够完善,因此有必要对于米成年犯的非刑行为寻找新的解决之策。面对我国未成年犯罪问题解决的现实困境,我们有必要检视当前我国的未成年犯非刑罚处置措施的现状,以域外大多数国家和地区所采取的少年保护处分制度为视角,分析我国未成年犯非刑罚处置措施存在的缺陷并剖析其背后的原因。借鉴国外的先进经验,并结合我国具体实际,完善我国未成年犯非刑罚处置措施,构建具有中国特色的保护处分制度,进而推进我国少年司法制度的改革。更多还原

【Abstract】 With the continuous development of the human society,juvenile delinquency has become a serious problem that both countries and regions need to pay attention to.In recent years,the rate of China’s juvenile crime has also rising.The phenomenon has brought serious adverse effects to our social order.As a result of our consistent penalty center doctrine,the punishment of our criminal law has been relatively heavy.Also,there is no difference between the way in which juveniles and adults are punished.In practice,pay attention to the punishment of penalty for treatments of the juvenile delinquency is not received good results.With the development of international juvenile criminal law,the transformation of juvenile offenders from penalty to non-penalty has become the consensus reached by all countries.Most countries and regions have developed special laws for juvenile delinquency.What’ s more,through the practice of extraterritorial also can see the punishment of non-penalty ways is more conducive to the prevention and treatment for juvenile delinquency.In the light of our country,the current situation of juvenile delinquency in the application of non-juvenile punishment is in trouble,mainly in the face of practical cases to deal with embarrassment and academic theory of controversy.The root cause is that our country’s juvenile non-penalty measures are still not perfect.Therefore,it is necessary to find a new solution to the rectification of juvenile offenders.In the face of the realistic dilemma of solving the problem of juvenile delinquency in China,it is necessary to examine the current situation of non-juvenile punishment in our country.From the perspective of the system of juvenile protection measures which the majority of countries and regions have used.Also to analyze the shortcomings of the juvenile offenders’non-penalty disposal measures and analyzes the reasons behind them.Drawing on the advanced experience of foreign countries and combing with the concrete reality of our country,perfecting the non-juvenile punishment measures of Chinese juvenile offenders,constructing the system of protection and disposition with Chinese characteristics,and then promoting the reform of juvenile justice system in our country.更多还原
