【摘要】 《黑格尔法哲学批判》,在马克思早期思想发展史中具有重要地位。本文运用逻辑与历史相统一的方法,通过对青年马克思的代表著作《黑格尔法哲学批判》(以下简称《批判》)的研究,揭示马克思早年对黑格尔法哲学批判的原因、基本内容以及该著作在马克思主义思想史上的地位和现实意义。论文共分为四章。第一章是分析《批判》的写作动因及理论来源。马克思在写作《批判》前一直有着苦恼的疑问,即国家与市民社会的关系问题。为了解答这个苦恼的疑问,回答国家的本质问题,马克思开始了对物质利益的反思和对市民社会的探索。这一时期,马克思开始从社会舞台退回到书房,用他一贯严谨的治学态度收集资料,整理了《克罗茨纳赫笔记》,同时借鉴了青年黑格尔派、费尔巴哈等人的思想,为批判黑格尔法哲学做了充足的理论准备。第二章是对《批判》的基本内容进行解读和分析,这是论文研究的重点。论文分析了马克思对黑格尔的法哲学理论以及其贯穿其中的唯心主义方法论的批判,重点研究了马克思对黑格尔的"市民社会"理论的批判、对黑格尔所谓的"国家制度"的批判、对黑格尔的唯心主义辩证法的批判等基本思想。第三章是对《批判》的理论价值进行分析。重点分析了《批判》在马克思主义唯物史观创立过程中的历史作用,指出马克思在批判过程中试图用唯物史观的观点和方法说明市民社会和国家的本质,体现出对黑格尔法哲学的超越以及与同时代青年黑格尔派的不同之处,同时也分析了《批判》存在一定的理论局限性和历史局限性。第四章是论述《批判》的现实意义。《批判》蕴含的唯物史观的萌芽,具有重要的现实意义。在全面建成小康社会、实现中华民族伟大复兴的历史条件下,我们要借鉴和汲取《批判》的合理思想,为我国的社会主义法治建设、经济体制改革、人民群众主体地位的发挥等提供理论支撑和思想服务。更多还原

【Abstract】 Critique of Hegel’s Philosophy of Right has an important status in the early history of Marx’s development.In this paper,through the unity of history and logic,we focuses on the research of Critique of Hegel’s Philosophy of Right that wrote by Marx in his youth as the representative work,which will study Marx’s critique about Hegel’s Philosophy of Right and the theoretical value and realistic meaning of the text.This paper will be divided into four parts.To begin with,the writing reasons and the theoretical sources of the text will be discussed.Marx had been in trouble before writing the text,so he started to ask the essence of country and rethink the material interests and also explore the questions about civil society.Marx began to return to the study from the social stage,who collected and analyzed the data with his always rigorous scholarship,thus coming out the Kreuznach Notebooks.At the same time,Marx combined the contemporary philosophic thinking including Young Hegelians and Feuerbach which made adequate preparations for the critique.The second part of this paper is about the basic content of the text,which is also the important part of the research.This part focused on the critique of Hegel’s Philosophy of right including his theory of civil society and so-called "state institutions" and his idealistic dialectic.The third part is the study of the theoretical value of the text.The emphasis is analyzing the historical impact of the text during the creation process of Marx’s materialist conception of history and pointing out that Marx tried to use this method to reveal the essence of country and civil society during the process of criticism.which also reflected the transcendence of the Hegel’ philosophy of law and the difference between the Young Hegelians.This part also discussed the theoretical and historical limitation of the text.The last part is realistic meaning of the text.The germination of historical materialism in the Critique has important realistic meaning.Under the new historical conditions,the Chinese dream of building a well-off society in an all-round way and realizing the great rejuvenation of the Chinese nation,we should learn and absorb reasonable value of the text and provide theoretical support for the construction of socialist rule of law and reform of the economic system as well as the development of the principle position of the people.更多还原
