云南省食品安全监管体制改革现状研究

【摘要】 食品安全问题是世界性难题,不管发达国家、发展中国家还是欠发达国家都还没有完全彻底解决。食品安全问题既是民生问题,也是政治问题,不仅关系到社会公众的健康与幸福,还可能影响到一个国家的国际形象,甚至直接影响社会稳定、经济发展及国际合作。近年来,为缓解日趋严峻的食品安全形势,我国不断加大整治力度,持续提高监管水平,多次进行体制改革,尤其是2013年推行的全国范围内的大部制改革,改变了过去分段监管的局面,开始探索建立集中统一的监管模式,体现了党中央、国务院高度重视食品安全这一重大民生问题以及从严监管的决心和力度。云南省严格按照国务院要求,充分整合分散在质监、工商、食品药品监管部门的食品安全监管职能和力量,重新组建云南省食药监局,同时加挂“云南省人民政府食品安全委员会办公室”牌子,紧随全国改革完善食品药品监管体制的步伐。但就体制改革后机构运转的情况看,职能转变程度不够、监管职责整合效果不明显、法律法规体系不完善、工作机制不健全、监管成效不显著、基层监管力量薄弱等问题仍然明显,还需要进一步加以研究解决。本文以食品安全监管体制大部制改革为背景,结合新一轮政府职能转变和机构改革,通过文献分析、案例分析、历史分析等研究方法,运用公共产品理论、整体治理理论对云南食品安全监管体制改革现状、存在问题进行深入分析研究,查找产生问题的原因,对进一步完善和深化云南省食品安全监管体制改革提出建议。更多还原

【Abstract】 Food safety is regarding the health and safety of the people, as well as the image and credibility of the Party and the government. In recent years, Chinese government continuously improve the food safety regulatory system, and has processed many reforms. The most important one was the super ministry system reform in 2013, which changed the situation that food safety was supervised by many departments. It indicates that China’s food safety regulatory reform has made a huge progress, and also shows that Chinese government has put much emphasis on the major livelihood issue-food safety, and shows the government’s determination and strength to supervise the food safety strictly.According to the Guidance of improving food and drug regulatory system reform from State Department, Yunnan Province integrates the functions and responsibilities of food safety supervision which were dispersed in many departments including Quality Supervision Department, Industrial and Commercial Administration, Food and Drug administration, and reorganizes the provincial Food and Drug Administration and the food safety Commission office of Yunnan Provincial people’s Government. Besides, Yunnan Provincial people’s Government also integrates the functions of Quality Supervision Department, Industrial and Commercial Administration, Food and Drug administration in counties and districts, and establishes the unified and comprehensive market regulatory departments. However, viewing from the operating effects after the reform, we can come to the conclusion that we still confront many problems. Firstly, there is a lack of functional transformation, and secondly the regulatory duties have not been effectively integrated. Thirdly, the regulatory effect is not obvious. Besides, the primary regulatory power is weak, and meanwhile the organizations are not optimized, etc. All of the problems need further research.This paper will focus on the major line of the super ministry system reform, integrated with a new round of institutional reform and transformation of governmental functions. Meanwhile, it will use many methodologies including literature analysis, case studies, field research, so as to deeply analyze the present situation and existing problems of food safety regulatory reform in Yunnan province, give suggestions on further improving and deepening the system reform.更多还原
