【摘要】 家庭暴力一直是国际社会关注的热点问题,世界各国（地区）通过制定反对家庭暴力的法律来预防和制止家庭暴力。在各国（地区）的法律中都不约而同的把人身安全保护令作为防范和制止家庭暴力的有力手段,我国也不例外。2016年3月1日我国正式实施的《反家庭暴力法》为法院审理人身安全保护令案件提供了法律依据。但《反家庭暴力法》的规定过于原则,具体操作性不强,并因为法律规定本身存在的缺陷,司法实践中出现了各种问题,使人身安全保护令未完全发挥其预防和制止家庭暴力的效果。笔者参考境外人身安全保护令的立法及司法实践经验,结合我国人身安全保护令的法律规定的不足以及在司法实践中存在的问题,提出完善我国人身安全保护令的建议。本文将通过四部分予以论述笔者的观点,笔者在前三部分的基础上提出了第四部分对我国人身安全保护令的完善建议。第一部分是人身安全保护令概述。这部分主要论述了人身安全保护令的历史发展,人身安全保护令的定义和性质以及人身安全保护令存在的意义。第二部分是外国及我国台湾地区人身安全保护令之评介。主要通过阐述德国、美国、日本、台湾的有关人身安全保护令的立法规定和实践经验,来阐述对我国人身安全保护令制度的借鉴意义。第三部分是我国人身安全保护令的亮点及不足。这部分首先阐述了我国《反家庭暴力法》中人身安全保护令的亮点规定,如将非家庭成员纳入到保护范围,法院作为独立案由受理,将“侵害”明确为侵害行为等；其次阐述我国人身安全保护令的不足,如家庭暴力界定片面、人身安全保护令内容缺乏全面,缺乏对未成年人的特殊保护,在司法实践中受害人举证困难、执行主体不科学等问题；最后结合笔者在实习中了解到的案件以及身边家庭暴力受害人的对人身安全保护立的看法阐述我国民众对申请人身安全保护令的顾虑。第四部分是我国人身安全令的完善。结合本文前三部分的内容,再根据专家学者对我国人身安全保护令的完善建议,以及笔者自己的看法,提出完善我国人身安全保护令的建议,如增加家庭暴力类型,完善人身安全保护令内容以及规定对未成年人的特殊保护,降低受害人的举证责任,做有利于受害人的推定、以及将公安机关作为执行主体等建议。更多还原

【Abstract】 Family violence has always been the hot topic in the international community, countries (regions) around the world have formulated laws against domestic violence to prevent and stop family violence. In the law of all countries (regions) are the personal safety of protection as a powerful means to prevent and stop family violence, our country is no exception. On March 1,2016, China formally implement the anti-family violence law for the court case has provided a legal basis for safety protection. But the anti-family violence law provision is too principle, concrete operational is not strong, and because of the flaws of the law itself, all kinds of problems in judicial practice, did not make personal safety protection order to reach its full effect. The author reference foreign personal safety protection experience in legislation and judicial practice, and the lack of safety protection of the law, and the problems in the judicial practice, hope to perfect our country’s personal safety protection put forward some Suggestions.This article will be discussed through four parts the author’s point of view, and put forward on the basis of the author in the first three parts part four Suggestions for the perfection of personal safety protection in China. The first part is the summary of personal safety protection order. This part mainly discusses the historical development of personal safety protection, the definitions and properties of personal safety protection and personal safety protection to the meaning of existence. The second part is the foreign and our country Taiwan area for safety protection in the comments. Mainly through the elaboration of Germany, the United States, Japan, Taiwan area about personal safety protection legislation and practical experience, to illustrate the significance in the system of our country’s personal safety protection order. The third part is the window of personal safety protection and insufficient in our country. This part, first of all, this paper expounds the anti-family violence law in the window of personal safety protection rules, such as the family members into the scope of protection, and, as an independent cause of action courts will \"violation\" clear for infringement, etc.; Second in this paper, the lack of personal safety protection in our country, such as domestic violence defined one-sided, personal safety protection makes the content less comprehensive, the lack of the special protection of minors, the victims in the judicial practice problems such as difficult, not scientific executive main body of proof; Finally the author learned in practice cases of family violence around him as a victim of perceptions of personal safety protection made in this paper, the application of the protection of the personal safety concerns people of our country. The fourth part is the improvement of the system of personal safety for. Combined in this paper, the content of the former three parts, then according to the experts and scholars Suggestions for the perfection of personal safety protection in China, and the authors own view, put forward the Suggestions of perfecting our country’s personal safety protection, such as increasing domestic violence type, improve the safety provisions to protect the content as well as for the special protection of minors, reduce the victim of the burden of proof, is advantageous to the presumption of the victim, and the public security organs as the executive main body and so on.更多还原
