【摘要】 改革开放以来,黑龙江省的经济取得了较快的发展,但由于村屯较多、生产企业设备老化等原因,火灾形势日益严峻,每年因火灾造成的人员伤亡和财产损失逐年扩大,给我们敲响了警钟。我国的消防安全管理体系长期以来受计划经济体制的影响,形成了由政府主管部门全权负责的“保姆式”消防管理体系,消防管理的一切工作由政府主管部门全权负责。在新《消防法》出台之后,确立了以政府为核心,社会和广大民众广泛参与的网络化消防管理体系,在这个结构中消防中介组织处于沟通和协调的枢纽位置。黑龙江省消防协会是目前黑龙江省职能最全、会员人数最多、架构相对最为完整的消防中介组织,因此,引导和促进黑龙江省消防协会的发展,承接部分政府转移的职能,对于促进黑龙江省消防事业的发展,保障人民群众生命财产安全等都具有重要的意义。正是基于以上背景,本文以黑龙江省消防协会为研究对象,运用新公共管理理论、新制度经济学理论、功能匹配理论,从承接政府职能转移的研究视角出发,借鉴国内外社会组织承接政府职能转移的成功经验,力求完善和拓展黑龙江省消防协会承接政府职能转移的体系,为黑龙江省消防协会更好地承接政府职能转移提供参考意见。研究发现,黑龙江省消防协会承接政府职能上存在着缺乏法律规范、官办色彩浓厚、培训机制落后、监管不到位等问题,针对这些存在的问题,并结合国内外社会组织承接政府职能转移的经验,按照政府主导、可行性、循序渐进、竞争等原则,根据政府职能理论、功能匹配理论等确定了黑龙江省消防协会承接的政府职能范围,构建包括移交-替代、委托-购买、授权-补助在内的三种具体承接政府职能运作方式,并在最后从政府、消防协会、社会三个层面提出促进黑龙江省消防协会承接政府职能转移的保障措施。更多还原

【Abstract】 Fire safety is an important part of the national social security system, is a measure of a city, a region or even is an important factor to consider the degree of civilization of a country. Since the reform and opening up, Heilongjiang province has achieved rapid economic development, but due to many villages, production equipment aging, the fire situation is increasingly serious, every year due to fire casualties and property loss is increasing year by year, gave us a wake-up call. China’s fire safety management system has been affected by the planned economy, formed by the government departments responsible for the "nanny" fire management system, responsible for all work of fire management by the government departments, in the event of fire safety accidents will be held related fire supervision responsibility. After the introduction of the new 《Fire Law》, established by the government as the core network fire management system society and the broad participation of citizens, in the structure of fire protection intermediary organization, communication and coordination in the key position. Therefore, to guide and promote the development of Heilongjiang Province Fire Protection Association, to undertake part of government transfer functions for Heilongjiang province to promote the development of the cause of the fire, is of great significance to protect people’s lives and property safety.It is based on the above background, this paper takes Heilongjiang Province Fire Protection Association as the research object, using the new public management theory, new institutional economics theory, function matching theory, from the perspective of the government to undertake the functions of the inspection of domestic and foreign social organizations to undertake the transfer of government functions and experience, and strive to improve and expand the Heilongjiang province to undertake the Government Fire Protection Association transfer functions of system, to better undertake the functions of the government to provide reference for transfer. The study found that Heilongjiang province fire protection association to undertake the functions of government are lack of legal norms, official colors, training mechanism, backward supervision is not in place and other issues, to solve these problems, combined with domestic and foreign social organizations to undertake the transfer of government functions, the construction of the system to undertake the transfer of government functions from the aspects of guiding ideology, principles, transfer path and mode, and finally put forward to promote Heilongjiang province fire protection association to undertake the safeguard measures for the transfer of government functions. Due to the transfer of government functions and departments involved in many aspects, the paper puts forward some suggestions in practice there are many problems and difficulties, I hope by later practice, this can make the further stuy direction.更多还原
