【摘要】 人们的生活方式总是朝着更快捷、便利的方向发展。由于传统购物模式需要花费大量的时间、精力,自然就为网络购物的兴起提供了极大可能性。快递服务业作为沟通买家与卖家的一个重要桥梁,也在这个大环境下迅速发展起来。虽然,快递公司为寄件人和收件人提供了便利的服务,但一些问题也随之发生。收件人个人信息被快递公司或是其工作人员非法泄露,快递公司投递快件延误、毁损,甚至派件员在派件时,因一时联系不到收件人而随意找人代收代签收件人的快件。诸如此类的情形时有发生,这给收件人的权益造成了极大的侵害。文章希望通过对与收件人权利有关的法律问题进行深入剖析,以求为收件人全面保护自己的合法权益提供建设性意见。快递服务合同的订立,使快递公司与寄件人以及收件人之间产生了法律上的联系。因此,首先需要对快递服务合同的产生、定义、性质等进行深入地分析。一旦确定快递服务合同是为第三人利益的合同,就能明确快递公司、寄件人以及收件人的法律地位和三者各自的权利与义务。其次,作为快递服务合同受益第三人的收件人的权利,在现实生活中经常受到侵害。特别是收件人的个人信息保护权、给付请求权、损害赔偿请求权以及知情权。文章将着重对这四项权利的内涵及其在现实中权利受损的现状进行深入探讨。最后,为了更好地维护收件人的合法权益,文章从三个方面,即快递服务合同性质的法律化、《快递服务》邮政行业标准的细化以及快递服务合同格式条款的改进,全面提出了具体的保护方案。更多还原

【Abstract】 The direction of People’s life style is always more quick and convenient.Because the traditional shopping patterns take a large number of time and effort,which offers a distinct possibility to the rise of online shopping.Courier services,as the important bridge between buyers and sellers,also develop rapidly in this environment.Although the express company provides the convenient service to the sender and recipient,some problems also occur.The personal information of recipients is illegally revealed by express company or its staff.The express company deliveries courier delay or damaged,or even when the express delivery man sends the package,because he can’t contact the recipient and ask other people to sign for the parcel.Such circumstances regularly occur,which deeply hurts the recipient’s rights.In order to provide constructive suggestions to protect well the recipient’s rights,the article deeply analysis the legal issues,which associate with the recipient’s rights.The conclusion of the courier service contract has legal relations among the express company,the sender and recipient. So,first of all,we need to deeply analysis the rise,definition and properties of courier service contract.Once we can confirm the courier service contract is the agreement for the Third Party’s interests.The juristic status among the express company,the sender and recipient,and their respective rights and duties.Which can be nailed down.In the next place,recipients,as the Third Party’s benefit of the courier service contract,whose rights are often violated in real life.Especially the rights about the recipient’s personal information protection,claim for payment and harm indemnity,as well as the right to know.The article will focus on deeply discussing the connotation of the four rights,and the four rights’phenomenon in reality.Finally,so as to well protect rightful interests of the recipient,the writings focus on three angles,which are the legalization of express service contract’s nature,the refinement of the Express service postal industry standards,and the improvement of courier service contract’s standard terms,fully advances the specific protection scheme.更多还原
