【摘要】 我国历经三十多年改革开放,经济社会都获得了高速发展,现在已经步入中等收入国家行列,国家正在经历法治化的伟大征程,社会追求公平正义的呼声日益高涨,时代对公安机关执法工作提出了更高要求。在这种背景下,公安部于2008年作出了公安机关执法规范化建设的重大战略部署。可以说,公安机关执法规范化建设已成为今后公安执法工作的重中之重,基层公安机关在整个公安系统执法工作中占有重要地位,研究基层公安机关执法规范化建设状况对推动公安机关执法规范化具有举足轻重的意义,可以丰富公安执法理论,从源头上提高基层公安机关执法水平,促进公平正义和依法治国理念在基层的弘扬发展。本文采用分析比较、调查实例、文献研究等方法,通过学习学术界有关论文资料,结合山东省日照市XX区公安机关执法规范化建设实例,并借鉴发达国家、地区警察执法工作的经验,分析我国基层公安机关执法体系中的不足和原因,提出方法对策,以期推动基层公安机关执法规范化建设。本文第二章解释了公安机关和基层公安机关的含义。论述了公安机关执法规范化建设与法治国家、公平正义理论的联系,为全文作了理论铺垫。通过研究学术界关于公安机关执法规范化建设研究的主流观点可以看出,公安机关执法规范化主要涉及执法主体、执法制度、执法保障和执法监督四个具体层面。历经数年执法规范化建设,XX区公安分局在执法主体、执法制度、执法保障和执法监督建设四个方面取得了很大进步,但仍存在一些问题,文章从源头分析了发生这些问题的原因。基层公安机关执法规范化建设道路是曲折漫长的,但我们充满着信心。结合实际工作经验,参考专家学者的思想理论,借鉴发达国家和地区先进经验和做法,本文从XX分局自身特点、公安机关共同点、其它方面三个角度提出对策建议。从日照市公安局XX分局自身可以采取的对策建议有：执法主体建设方面要改进理念,加强学习；执法制度建设方面,制度制定从实战出发；执法监督建设方面,加强内部监督；执法保障建设方面,资源向基层倾斜。从公安机关可以共同采取的对策建议有：执法主体建设方面,执法理念与业务水平双提升；执法制度建设方面,重视制度完善与落实；执法监督建设方面,加强警务公开与内外监督；执法保障建设方面,人力、物力、安全保障并举从其他方面的辅助性对策建议有：明确界定政府权责,杜绝不作为；加强法制宣传,营造法治环境。总之,本文力图对基层公安机关执法规范化建设作出比较全面、比较切合实际的研究论述。更多还原

【Abstract】 After more than thirty years of reform and opening up, China’s economic and social development has been the rapid development, and now has entered the ranks of middle-income countries, the country is going through a great journey of the rule of law, the voice of social pursuit of fairness and justice has become increasingly high, the era of public security organs of law enforcement work put forward higher requirements. In this context, the Ministry of public security in 2008 to make a major strategic plan for the construction of law enforcement standardization.It can be said that, the construction of law enforcement standardization in public security organs has become the top priority of future public security law enforcement work, the basic level public security organ in the public security law enforcement work occupies an important position, standardizing law enforcement of the grass-roots public security organs of building to promote the public security organs of law enforcement standardization has important significance, can enrich the public security law enforcement theory, from the source to improve law enforcement level of basic level public security organ, promote fairness and justice and the rule of law concept in the base to promote the development.The comparative analysis, case studies, literature research methods, through the study of relevant academic papers, combined with Shandong Rizhao city XX district public security organs and law enforcement construction examples, and draw lessons from the experience of developed countries and regions of police law enforcement work, analysis of China’s enforcement of basic level public security organ system deficiencies and the reasons and put forward countermeasures, in order to promote grass-roots public security organs to the construction of law enforcement standardization.The second chapter explains the meaning of public security organs and grass-roots public security organs. This paper discusses the relationship between the standardization of law enforcement in public security organs and the state of law and the theory of fairness and justice, and makes a theoretical foundation for the full text.The academic research on the norms of law enforcement of public security organs of the main arguments of the research on the construction of can be seen, the public security organs of law enforcement standardization mainly involves the subject of law enforcement, law enforcement system, enforcement of security and law enforcement supervision four specific level. After several years of construction of law enforcement standardization, XX District Public Security Bureau in the four aspects of subject of law enforcement, law enforcement system, enforcement of security and law enforcement supervision of construction has made great progress, but there are still some problems, the from the source to analysis the causes of these problems.Basic level public security organs of law enforcement standardization construction road is tortuous, but we are full of confidence.Combined with practical work experience,the experts and scholars of ideological and theoretical reference and draw lessons from the advanced experience and practices of developed countries and areas,this paper from the three angles of XX Branch of its own characteristics, the public security organs in common,other aspects put forward countermeasures and suggestions.Rizhao City XX district public security organs themselves can take countermeasures and suggestions;Law enforcement of the main building, the concept of improvement, to strengthen learning;Law enforcement system construction, the system developed from the actual combat;Law enforcement supervision and construction, to strengthen internal supervision;Law enforcement and protection construction, the resources to the grassroots tilt.Public security organs can jointly take the countermeasures and suggestions;Law enforcement of the main building, the concept of law enforcement and business level double upgrade;Law enforcement system construction, pay attention to the improvement and implementation of the system;Law enforcement supervision and construction, to strengthen the supervision of the public and internal and external supervision; Law enforcement and protection construction, human, material, security and security simultaneously.Other aspects of the supplementary countermeasures and suggestions;Clearly defined government responsibilities, to eliminate non;To strengthen the legal publicity, and create a legal environment.In a word, this paper tries to make a more comprehensive and practical research on the construction of law enforcement standardization of grass-roots public security organs.更多还原
