论我国当前的青少年犯罪问题及其预防

【摘要】 青少年的健康成长,关系到一个家庭的幸福,关系到一个民族的希望社会的稳定、和谐、发展等都和青少年健康成长息息相关。青少年犯罪问题是自从人类社会产生就一直存在的社会问题。二十一世纪,随着科学技术水平不断地发展,我国的经济实力也越来越强大,但我国目前青少年犯罪问题也越来越严重,已经引起国家和社会的高度重视。公安部统计数据显示,2012年至2014年违法犯罪人员总体中,18周岁以下青少年罪犯在总数中所占比例为：2012年24.4%,2013年26.2%,2014年27.7%。根据数据分析可以得出,青少年犯罪人数占全国罪犯总人数的比重相当高,并且每年青少年犯罪的比例都有增加的趋势,其中18周岁以下案件总数已达到全部案件总数约30%。而恶性化、低龄化、团伙化的犯罪特征是中国青少年犯罪发展总趋势。我国投入了大量的人力和物力预防青少年犯罪和矫正已经犯罪的青少年,由于受到诸多方面因素的影响,预防的效果不容乐观。如家庭没有尽到责任；学校不能充分发挥青少年犯罪预防作用；法律规定社会职能部门作用不明确；现有的法律体系不完善；忽视被害人的作用；受文化和理念差别；城市和农村在青少年犯罪预防的效果差距较大。如何保护青少年健康成长,遏制青少年违法犯罪行为的发生,是我们每一个人都值得关注的话题。本文将从法学理论角度,研究国内青少年犯罪的特点和相应的预防对策,以便有效的遏制青少年犯罪案件高发趋势,保护青少年健康成长。本文首先对我国当前青少年犯罪现状进行了汇总。文章第二部分针对青少年犯罪主要特征和犯罪类型进行了详细的阐述和分析。第三部分运用法律逻辑的方法,对我国青少年犯罪形成的主客观方面原因进行了全面剖析。第四部分对以往青少年犯罪预防理论和实践归纳和总结,从法理学的角度研究当前我国青少年犯罪原因,建立我国当前青少年犯罪微观预防体系和宏观预防体系。更多还原

【Abstract】 The healthy growth of young people, the relationship to the happiness of a family, the stability, harmony and development of a nation’s hope society are closely related to the healthy development of young people. Juvenile crime is a social problem that has been in existence since the human society. In twenty-first Century, with the development of science and technology, the economic strength of our country is more and more powerful, but the problem of juvenile delinquency is becoming more and more serious, which has caused the high attention of the state and society. Ministry of public security statistics show that from 2012 to 2014, the total number of offenders under 18 years of age, the proportion of juvenile offenders in the total,2012 24.4%, 2013 26.2%,2014 27.7%. According to data analysis can be drawn, the number of juvenile crime in the country the proportion of the total number of offenders is quite high, and every year the proportion of juvenile crime has increased trend, the total number of cases of 18 years of age has reached a total of about 30%. The characteristics of the crime of malignant, younger age, gang is the general trend of development of juvenile delinquency China. China has invested a lot of manpower and material resources to prevent juvenile delinquency and criminal correction has been a crime, because of the influence of many factors, the prevention of the effect is not optimistic. The school can not make full use of juvenile delinquency prevention function, the role of social functions is not clear, the existing legal system is imperfect, the role of the victim, the difference between culture and ideas, and the effect of urban and rural areas in juvenile delinquency prevention. How to protect the healthy growth of young people, to curb the occurrence of juvenile delinquency, is a topic that we should pay attention to. This paper will study the characteristics of juvenile delinquency and the corresponding preventive measures from the perspective of legal theory, so as to effectively curb the high incidence of juvenile crime, and protect the healthy growth of young people.This paper first summarized the current situation of juvenile crime in China. The second part of the article mainly expounds and analyzes the main characters and types of juvenile crime. The third part uses the method of the legal logic, the reason of the subjective and objective causes of the formation of the juvenile crime in our country. The fourth part of the past youth crime prevention theory and practice of induction and summary, from the perspective of the current research on the causes of juvenile crime, the establishment of China’s current youth crime prevention system and macro prevention system.更多还原
