【摘要】 科学的管理是一切社会活动内在的必然的要求,审判活动也不例外。案件质量评估就是基于对审判规律的正确认识和把握,对审判行为与过程调控、评价、引导的一种重要的审判公正机制。20世纪90年代中后期,一些法院率先在审判流程管理领域进行了积极有益的探索,开启了人民法院审判管理改革的历程。1999年最高人民法院颁布的《人民法院五年改革纲要》,第一次明确提出了有关审判管理的改革任务,而审判管理的核心内容就是做好案件质量评估工作。之后,审判管理改革伴随着人民法院司法体制和工作机制改革的深入而不断推进。目前,山西省高级人民法院制定了“山西省法院审判质量评估考核指标体系”,总计23项指标,分别是审判公正指标9项、司法效率指标7项、司法效果指标7项三个部分。当前案件质量评估工作虽取得了重要的成就,但仍面临着许多新情况和新问题,这就对做好案件质量评估工作提出了更高的要求,以使案件质量评估管理逐渐成为人民法院内部既有别于案件审判、又不同于司法人事管理、司法政务管理的一项重要的司法管理活动,审判管理在人民法院管理体系中的核心地位将不断得到强化。2013年,笔者的导师展开了为期一年的实证研究,而本文是对山西省案件质量评估考核指标体系部分成果即审判公正指标体系进行理论上的深化,以期完善审判公正指标体系,使其更加符合当前山西省的司法实践,开创全省法院审判工作科学发展的新局面。全文分为引言、正文、结语三个部分,其中正文部分包含的内容有：第一部分介绍了山西省审判公正指标体系设计与实施的实证分析情况,具体细分为山西省审判公正指标体系设计实证分析和山西省审判公正指标体系实施效果分析两个方面,以实现对审判公正指标进行全方位的了解。第二部分是阐述了审判公正指标体系实施中存在的问题,通过对实地调研数据的解读以及对实地访谈内容的剖析,掌握了审判公正指标存的问题,具体包括审判公正指标体系设计不合理、审判公正指标运行不规范以及审判公正指标存在异化三个方面。第三部分是关于完善审判公正指标体系的基本对策,科学构建山西省审判公正指标体系,完善指标设计；切实解决山西省审判公正指标运行中的违规行为,回归正常的运行轨迹；努力克服审判公正指标异化现象,必要时去掉该指标。更多还原

【Abstract】 Scientific management is necessarily inherent requirements of all social activities, judicial activities is no exception. Cases quality assessment is based on the correct understanding and grasp of the law of the trial, the trial conduct and process control, evaluation, and guide an important mechanism of justice. In the late 1990s, some courts have pioneered the field of process management in the trial were positive and useful exploration, opening the course of the trial court management reform. "People’s Court Reform Program for five years," promulgated by the Supreme Court in 1999, for the first time explicitly put forward the reform of the management tasks related to the trial, and the trial of the core content of the quality of case management is to do the assessment.After trial management reform accompanied by a people’s court-depth reform of the judicial system and working mechanism and continuously push forward. Currently, Shanxi Province Higher People’s Court formulated the "Shanxi Province, the trial court to assess the quality assessment index system", a total of 23 indicators, which are indicators of nine justice, judicial efficiency targets 7, judicial performance metrics seven three parts.
