农村土地承包经营权流转信托模式的法律问题研究

【摘要】 人口众多,土地资源相对稀缺是我国的基本国情。农村土地制度的完善和土地的整体利用率,不仅会影响到我国国民经济的持续、稳定增长,而且关系到我国市场经济的发展。土地承包经营权的流转是我国农村极其重要的土地流转形式之一。它的合理高效、规范有序的流转不仅可以加速我国现阶段的新农村建设,而且能够很好的保障农民权益,在提高农村土地资源整体的配置效率和防止土地闲置浪费方面起到重大作用。我国《农村土地承包法》明确规定,通过家庭联产承包取得的土地承包经营权可以依法采取转包、出租、互换、转让或者其他方式进行流转。传统的流转方式无疑在一定程度上限制了我国农村土地承包经营权的流转进程。因此,对农村土地承包经营权流转方式的探索就尤为重要。本论文以宿州市为例,对当地的农村土地承包经营权的流转情况、存在的问题以及本地对土地流转信托模式的探索进行实地调研的背景下,主要分析将信托引入宿州市农村土地承包经营权流转的合法性基础和法律构造,并对我国农村土地承包经营权流转采用信托模式可能出现的风险进行法律防范提出相关的措施。主要包括修改完善我国的《信托法》,建立健全农村社保体系和信托监督体系来降低土地承包经营权流转的风险,以求更好的推进农村土地承包经营权流转的进程。更多还原

【Abstract】 A large population and scarce land resources are basic national conditions of China. The perfection of rural land system and the overall land utilization ratio not only influence the sustained and stable growth of our national economy, but also concern the development of our market economy. The circulation of contracted management right of land is one of the extremely essential forms of land circulation. Reasonable, efficient, standardized and orderly circulation not only accelerates new rural construction in China at the present stage. Traditional circulation, without doubt, restricts the circulation process of rural contracted management right of land in our country. Therefore, it is particularly important to explore the circulation methods of rural contracted management right of land.This paper takes Suzhou City for example, investigates local rural circulation of contracted management right of land and existing problems on spot and explores a local land circulation trust model. Under this background, it mainly analyzes the legitimate foundation and legal constitution of trust being introduced into Suzhou rural circulation of contracted management right of land. Also, it proposes relevant legal measures to prevent possible risks when the trust model is used in Chinese rural circulation of contracted management right of land, mainly by modifying and perfecting Trust Law, setting up and perfecting the rural social security system and trust supervision system and reducing risks in rural circulation of contracted management right of land, in the hope of better promoting the process of rural circulation of contracted management right of land.更多还原
