【摘要】 人民代表大会制度是我国的根本政治制度。根据宪法,县级以上的地方各级人民代表大会设立常委会,在闭会期间行使权力,并向本级人民代表大会负责并报告工作。在地方各级人大常委会的各项职权中,监督权处于十分重要的地位,较之检察机关的法律监督、党委的纪检监督、行政机关的行政监察、政协的民主监督与社会的舆论监督,人大监督处于我国监督体系的基础和核心地位。但与上述地位不相匹配的是,地方各级人大常委会可用的监督方式却并不丰富,甚至可以说是捉襟见肘。2006年通过的《中华人民共和国各级人民代表大会常务委员会监督法》(以下简称《监督法》)规定了听取专项工作报告等7种方式,但其中质询、特定问题调查和撤职案等被束之高阁,未能发挥应有的作用。在被广泛采用的4、5种监督方式中,地方各级人大常委会在实践中也面临不少困惑。与此同时,个案监督、述职评议两种并非一无是处的方式,却因种种原因,未能进入监督法,实践中也已销声匿迹。在此,笔者以执法检查、专题询问、述职评议、个案监督为切入点,通过查阅人大资料、寻访专业人士等手段,结合自身10多年来的工作实践,深入进行思考,探析各级人大常委会监督方式的时代背景、历史由来、法律依据及实践困惑,提出具有操作性的意见建议,以期对我国地方各级人大常委会进一步改进监督工作有所裨益,对未来《监督法》的修订和其他人大监督方面的立法工作有所启发。更多还原

【Abstract】 The people’s Congress system is China’s fundamental political system. According to the Constitution, local people’s congresses at and above the country level establish standing committees, exercise of power during the intersessional period, is responsible and reports on its work to the people’s congress at the corresponding level. On the functions and powers of local people’s congress, supervision is very important. Compared with the legal supervision of the procuratorial organ, Party committee of discipline inspection and supervision, administrative supervision, the CPPCC’s democratic supervision and supervision by public opinion, supervision by the NPC of China is at the heart of the supervision system.But did not match the status, the supervision approaches of standing committee of local people’s congress at various levels available are not rich, and even can be said to be very few. In 2006 the "Law of the People’s Republic of China on the Supervision of Standing Committees of People’s Congresses at Various Levels" provides 7 supervision approaches, but all of the investigation of specific issues, questioning and dismissing case are put away unheeded, fail to play its due role. In the widely used 4,5 approaches of supervision, the standing committee of people’s congresses at various levels are facing a lot of confusion in practice. At the same time, debriefing appraisal and individual case supervision, fail to enter the supervision law for various reasons. Practice of the two supervision approaches has also disappear.According to the law enforcement inspection, specially designated inquiries, debriefing appraisal, individual case supervision, through consulting data, having interview with specialist and other means, the author thinks deeply with work practice of more than 10 years, analysises the era background the history, legal basis and practical confusion of supervision approach of the standing committee of local people’s congress at various levels, puts forward the operational suggestion, which is helpful to the further improvement of local people’s congress supervision, inspires future legislation amendments to the supervision law and other aspects of the supervision of the National People’s congress.更多还原
