我国动产抵押制度的缺陷与完善

【摘要】 由于动产抵押制度与传统物权法律体系特别是公示体系的冲突,使其产生到现在一直成为争论的焦点,也这是由于这个原因其在传统大陆法系国家发展缓慢。我国自1995年担保法引入动产抵押以来,有关该制度的争论一直存在,但是始终没有一个特别好的方案进行解决,随着企业对动产融资的需求越来越大,使得这个问题的解决越来越紧迫。鉴于这个背景,本文拟对我国的动产抵押制度进行分析,力图找出缺陷并提出切实可行的解决方案。首先,本文对动产抵押制度的基础理论包括比较法概况进行了较为详尽地介绍,为我们全面客观地了解该制度奠定了基础。其次,本文以我国动产抵押法律制度为基石分别从公示制度、效力制度、权利实现制度三方面对其主要缺陷进行了剖析,并分析了动产抵押制度存在的必要性。最后,笔者结合我国动产抵押制度存在的缺陷提出了解决办法,形成了以完善我国动产抵押公示制度为核心的解决机制。更多还原

【Abstract】 Because especially in conflict publicity system and the traditional system of chattel mortgage property legal system, to produce up to now has been a focus of debate, and it is for this reason the slow development in the traditional civil law countries. Since 1995 the country introduced chattel mortgage security law, the debate about the regime has always existed, but never a particularly good solution to resolve, as the demand for real estate financing business is growing, so that to solve this problem increasingly The more urgent. Given this background, this paper on China’s chattel mortgage system for analysis, trying to identify deficiencies and propose practical solutions. Firstly, on the basis of the theoretical system of chattel mortgage, including comparative law overview for a more detailed introduction, laid the foundation for our comprehensive and objective understanding of the system. Secondly, the paper of China’s legal system as the cornerstone of the chattel mortgage were from the public system, the effectiveness of the system, the rights of the three aspects of the system to achieve its main defect analysis, and analyzes the necessity of the existence of chattel mortgage system. Finally, the author of chattel mortgage system defects proposed solutions, the formation of a chattel mortgage to improve our public system as the core of the settlement mechanism.更多还原
