国有土地上房屋征收补偿问题研究

【摘要】 2011年1月21日,被人们期待已久的《国有土地上房屋征收与补偿条例》公布并开始施行,新条例在很多方面不负众望,包括明确了“公共利益”,规范了征收补偿的程序,完善了补偿机制,取消了“行政强拆”,建立了对被征收人合法利益多重保护机制以及明确了法律责任等。相比以前的《城市房屋拆迁管理条例》,新条例的一系列新规定无疑取得了具有实质性、标志性意义的进步。但是由于房屋征收补偿问题本身的复杂性,新条例还存在很多问题亟待解决。比如公共利益的进一步界定问题、评估问题、补偿问题以及强制执行的问题等,还需要更为深入的研究与探索。本文从司法实践的角度,对上述问题进行了探讨并提出意见,希望可以为房屋征收补偿的理论研究和实践发展贡献一己绵薄之力。更多还原

【Abstract】 Including has been clear about the public interest, perfect the compensation mechanism, cancelled administrative evictions, established protection mechanism of a legitimate interest expropriated for multiple and clear the law responsibility, etc. By contrast, can have substantial progress. But because of the complexity of the house expropriation and compensation problem itself, the new ordinance still exist many problems to be solved. Such as the definition of public interest problems, evaluation, compensation, and enforcement problems, still needs further research and exploration. In this paper, the author combined with the perspective of judicial practice, probes into the problem and put forward the opinion, hope can for the house expropriation and compensation problem of contribution to the development of theory and practice.更多还原
