我国基层行政复议中存在的问题及对策研究

【摘要】 2014年10月,十八届四中全会对我国全面推进依法治国做出了重大部署,为各级政府部门坚持依法行政、打造法治型政府指明了前进的道路与方向。2015年是我国全面推进依法治国的开局之年,做好新形势下的依法行政工作尤为重要。全面推进依法治国需要我国经济、社会各领域不断深入贯彻落实中央全会精神,以实际举措来打破传统体制机制的弊端,进一步加强行政管理领域的监管力度,通过改革创新与依法行政破解政府治理的难题。要按照“法无授权不可为,法定职责必须为”的要求开展基层政府依法行政工作。在当前我国基层行政复议领域里,仍面临着严峻的问题和考验。随着我国现代化和城市化步伐的加快,在城乡一体化迅速发展的背景下,基层群众的信访案件也在逐渐增加。如何充分发挥行政复议功能作用,规范相关流程及制度,加强监管力度,切实为基层群众维护合法权益,这是当前基层行政复议领域研究的一个重要课题。以某一基层区域为例,将我国基层领域行政复议现状及存在问题进行描述,根据其共性与个性问题开展对策研究,有利于为基层复议领域“融化坚冰”,破解难题提供思路。更多还原

【Abstract】 In October,2014, The fourth plenary session of the party’s 18 has made the significant development, for government departments at all levels adhere to administration according to law, build government to point the way forward and direction.2015 is ahead the starting year of the rule of law in our country,to do a good job of administration according to law under the new situation is particularity important. Comprehensively promote the rule of law to the economic and social fields in our country to carry out the central plenary session spirits. Practical measures to break the disadvantages of traditional system mechanism,to further strengthen the regulation of administrative areas, through innovation and crack problem of government administration according to law. According to “law without authorization for statutory duties must be” requirements to carry out the basic unit government administrative work in accordance with the law.In the field of the current our country grass-roots administrative reconsideration,still faces a serious problem and the test. The quickening pace of modernization and urbanization in our country,under the background of the rapid development of urban and rural integration,,the grassroots complaint cases are also increasing.How to give full play to the function of administrative reconsideration,norms related processes and system,strengthen supervision, protect the legitimate rights and interests for the grassroots, this is the current primary an important subject in research of the administrative reconsideration.In some areas at the grass-roots level,for example,the areas at the grass-roots level in our country present situation and existing problems countermeasures study, conducive to“melt the ice”grassroots reconsideration areas, solving problems.更多还原
