【摘要】 在我国的建设工程施工领域内，借用资质、非法转包、违法分包等现象大量存在，工程的名义承包人和施工任务的实际承担者往往并不一致，这些施工者完成工程后经常面临着拖欠工程款的情况，但他们的权益却很难得到保护。2005年最高人民法院的一个司法解释中首次提出了实际施工人的概念，并对实际施工人的工程款权益保护做出了规定，但是由于司法解释中的规定并不详尽，导致其在实际适用过程中出现了一些问题，本文对实际施工人工程款权益保护的相关问题进行了梳理，文章的主要部分为第二章到第四章，其结构如下：第二章是对实际施工人的范围进行界定，包括实际施工人的具体概念以及实际施工人包含的类型，其中指出实际施工人与合同法中的施工人是两个不同的概念，并探讨了实际施工人的存在形式。第三章是结合案例分析实际施工人权益保护中存在的问题，主要包括法院在审理相关案件中面临的几个争议问题，例如挂靠人的诉讼主体资格、欠付工程款的范围、实际施工人在诉讼中的地位，还提到了实践中存在的恶意诉讼情况。第四章对实际施工人主张工程款权益的法律依据进行了探究，先是分析了现有的几种不同观点，并对实际施工人向发包人主张权利的法律基础进行定性，再论述了实际施工人主张工程款的具体方式，最后对完善实际施工人工程款权益的保护提出建议。更多还原

【Abstract】 In the field of constructional engineering in China, borrowing qualification andillegal subcontracting abound. The nominal engineering conductor and the actualundertaker of construction tasks is often inconsistent, those actual builders often facedefault on construction cost after completing the construction projects, but it’s difficultfor them to protect their legitimate rights and interests. A judicial interpretation of theSupreme Court in2005first proposed the concept of the actual builder and made rulesabout the protection of their construction cost rights. However, the inexhaustive rules injudicial interpretation result in some problems in the practical application. This articleexplores the related issues about protection of actual builder’s construction cost rights,the main structure of this article is as follows：The second chapter is to define the scope of the actual builder, including thespecific concepts and type of actual builder, which points out that the actual builder andthe constructor in Contract Law are two different concepts, and this chapter alsodiscusses the form of actual builder.The third chapter analyzes the problems existing in the protection of actualbuilder’s construction cost rights based on some cases, which include controversialissues in court cases such as litigation subject qualification of affiliated person, thescope of default on construction cost, the status of actual builder in lawsuit andmalicious lawsuit.The forth chapter discusses the legal basis about why actual builder can claimconstruction cost rights. First of all, this chapter analyzes different opinions anddetermines the nature of legal basis, then it expounds the specific way of how actualbuilder claim the construction cost, finally it makes some suggestions to improve theprotection of actual builder’s construction cost rights.更多还原
